I recieve a NIP for doing 81mph in 70mph zone on A90 Dundee to Stonehaven Road. There is average speed cameras along this route

The NIP was sent within 14 days limit and I am the registered keeper.

I notice on the forum that I should sent "unsigned" NIP?

Also on the NIP section A - I do not see anywhere to enter my name but it asks me to complete driving licence, sex, telephone number, and occupation.

I do not want to give details, can I leave them blank?

TIA

You only have to provide sufficient detail to identify yourself, from which the police can get all the other information anyway. No point making yourself a bigger target really.

If you are going 'unsigned' then that would be the best.

I believe the unsigned option is still a possibility in Scotland, but people will be cagey about actually suggesting you do it.

Really? I see people on here suggest it all the time.

If you search on this forum for examples of people who have taken that route you will see that, particularly if you live in Scotland, you can expect the police to make repeated attempts to get you to sign the form. Fiscals have initiated legal proceedings but so far have abandoned them at the last minute.

Thanks for the advice. I will put my name and address on Section C only and leave it unsigned.

There is no place to put my name and address on Section A.

I will let you know the outcome, maybe it will be 6 months

You may want to ask the forum for details on how to handle the next 6 months.

As no-one here can see the form, saying Section A and C is meaningless.

Some forms now only require you provide name and address of a nominated driver, if you are confirming the recipient is the driver they don't require it, do not confuse the issue further is section C is for nominating someone else!

To use up time, always delay your reply as late as sensibly possible while ensuring it arrives on or before day 28 from the day it was served (which is day ONE not day zero).

Thought it might have been asking them to do something illegal.

No - they’d not be allowed to say it at all (on here) in that case. So far as I’m aware, the Scottish courts have yet to follow the English courts in saying that signing is a requirement. Therefore, advising not to sign is not categorically unlawful presently.

I sent the unsigned NIP with just my name and address on Section C.

They sent back with a letter attached along with a new NIP form.

What should I reply or should I ignore it?

If they speak to you at any stage just reply that you have already done everything required by law.

It's very interesting to note the wording of the letter, They are not saying you have to do anything, they are asking you to please do as they say and are thanking you for your cooperation. It almost reads as an implicit acknowledgment that while it may be unfortunate (for them) that the matter cannot be progressed, you are not required to do anything, they're just asking nicely.

It's also interesting to note that they say you have completed the NIP incorrectly and have sent you a new one. In fact it is the response to the S172 notice that you have completed "incorrectly". The NIP is simply a notice and requires no response.

Ignore the letter. You might now want to know what happens in the next 5 and half months. You might want to focus on how to manage the next 5 and half months. And also establish what the police will do.
If you live in Scotland it's going to be a rough ride. If you live outside Scotland or work regularly away from home, then it will not be so rough.
