Hi Guys,

I am speaking on behalf of somebody else - ncp ticket left on car windscreen - person in a rush with child and forgot to put ticket on windscreen. I have done some research and the majority of the advice seems to be to simply ignore everything.

this happened in a train station carpark.

Simply ignore it?

The advice has not been ignore since 2012.

Is the car park covered by byelaws, ie on railway land?

Whilst NCP are not particularly litigious the advice to ignore has generally not advised since 2012.

There are ways to deal with such tickets but best if the person themselves can post?

I have read over the PCN and no where does it mention anything about bylaws or railway land (I guess it would not even if that was true)

the location was billericay railway station. How would I check it it did fall under the above?

Pictures of signs would be handy. It is likely that the NtK that will follow (they have to wait 28 days) will not claim any 'keeper liability'. (Under Protection of Freedoms Act)

The general advice for these tickets is to 'appeal' as the keeper around day 21/22 to stop them accessing the DVLA to put the icing on the cake. They may reject any appeal but POPLA will uphold a lack of keeper liability case.

Up to date photos will help but from GSV it looks like Rail byelaws may well apply becauser the TOC name is on the sign alongside NCP.

so it seems the railway bylaws apply which I have just read up on.

The PCN states "if you wish to appeal this PCN you should write to us in the first instance. We will consider your appeal and respond to you within 35 days. if we reject your appeal we will give you the contact details of the independent appeals adjudication service."

OK so appeal AS THE KEEPER so that the appeal arrives just befroe the end of the time given for appealing. Mention the unclear signs, the lack of keeper liability, anything.

You must give your name and address so that they can write back to you but a small change in the address from that on the V5 so that you know if the have or have not contacted the DVLA. Say Greene Road instead of Green road. If the fail to send you an NTK within 56 days then they can't hold the keeper liable, if they don't' contact the DVLA they cannot hold the keeper liable. They don#t know who the driver was and you don't have to tell them.

You then have a letter ping pong with them for 6 months so that they can't take byelaw action.

When you say, "forgot to put ticket on windscreen", do you mean a ticket was purchased but not placed in view; or that a ticket was never purchased?

If it is the former, and this has happened to me on a good number of occasions, take a photo (or post the ticket) to the NCP and explain that it was purchased but not placed in view and in my experience, you'll be fine.

thanks guys I will draft a letter. she never got a ticket was occupied with 2 year old.

Tbh my self was parked in carpark yesterday (different one) even I 2nd guessed if I had put ticket on the window. thankfully I had, sometimes we go into automatic mode . Like when your driving on the motorway sometimes and 10 minutes goes by...

I dont agree with this ticket setup. There should be barriers on exit. Its very simple but then they would miss out on millions and millions each year..

I am off on holiday tomorrow smile.gif but I have prepared a letter as 'registered keeper' and left this with somebody to post next tuesday which would be say 22.

Should I send this 1st or 2nd class guys?

the Ticket was dated 3rd of september?
