Letter from Gladstones Solictors, Park Direct UK Limited

Hi,

I foolishly ignored a parking notice some months ago and all letters from various companies and have now received this letter from Galdstones Solictors; the letter is dated 19/7/2017 and I received it yesterday which was the 27th so 8 days after the letter was dated so I would really appreciate a quick response please.

We have been instructed by Park Direct UK Limited in relation to the above debt. It is our client's case that you are liable for these charges and we would like to draw to your attention the options that our client has in order to recover these from you.

The Supreme Court case of Beavis v Parking Eye [2015] recently confirmed the lawfulness of charges based in contract and their recoverability in Civil Law. Prior to this case being decided there had been a common misconception that such charges were
unrecoverable. The law is now clear.

Our client now has the option to commence proceedings in the appropriate Civil Court. This right exists for a period of 6 years (the limitation period) from the date of the parking charge although it is our client's preference to resolve this matter as soon as possible. A claim would result in an increase in the amount sought in terms of any Statutory Costs and Court Fees.

Our client would like to provide you with this opportunity to contact their agent to make full payment in the sum of £160 thereby avoiding the consideration of any future court action and any increase in the amount claimed.

This is a letter from DRP pretending to be a letter from Gladstones. The clue is in the reference number. DRP = Ignore.

Try the phone number and see who answers. Hang up and do not talk.

Unfortunately they do tak people to court, look here.

It is suggested that you write back to Gladstones to ask them to confirm that the letter was from them and you are disputing any liability anyway.

Post up a copy of the original Notice to Keeper, with identifying details removed, so that people can help if they continue.

Thanks guys, really, really appreciated this. I have emailed Galdstones and I will post the original NtK. I want this to go away now so am tempted just to pay but £160 is way above what the original fine was.

Is there anyway they would just accept the original fine now or has it gone past that stage.

I wish I had come to this site in the first place!

This is not a fine, it is a speculative invoice for an alleged breach of contract.

I hope you have kept all the paperwork. Post up a copy of the original Notice to Keeper (and Notice to driver if a windscreen ticket) and copies of the signs. Redact all identifying details.

Do not disclose the identity of the driver.

Here's some info on the company. They do take people to court.

You've just created a huge problem for Park Direct and Gladstones

In the event of a claim, Park Direct would have to explain why it paid £60 for its debt collector to send a forged letter
It can't deny knowledge of the letter when its solicitor has a copy of it and has refused to confirm it as genuine

As a solicitor, Gladstones' first duty is to the court, not its client
It would have to explain why it brought a claim that it knew to include a sum founded on an illegal document

Find a post from Andy Foster. Look at his signature. It says all you need to know about implying something from false words.

What timeframe should I expect a response (or not) from Gladstones? Also I forgot to add that the vehicle parked there on two occasions.........so I have two charge notices. I will upload all the paperwork but the original tickets that were stuck to the screen have faded.
