You were stopped at the roadside, and from what you say were warned you may be prosecuted, so you won't be getting a postal NIP.

He didn't have to give you any paperwork at the roadside.

The likelihood is you'll receive a CoFP normally within 2-4 weeks from date you were stopped. Clear instructions on what to do will be included.

As is usual on this forum, start by posting up all of PCNs. Redact only personal details, i.e. name, address, VRN and PCN number. Leave everything else in.

Also post up videos.

As is usual on this forum, post up all sides of PCN, your initial appeal, their rejection and the NTO.

Also post their photos and a link to GSV.

You do know that DYLs cover from the middle of the road, kerbs, paths and verges out to the private property line?

Umkomaas. Just tried sending you a PM, but got message saying you don't accept messages????

Too many unsolicited newbie PMs asking/demanding personal off-forum involvement in dealing with their PCNs. Never sure who people are on a public forum.

I've unblocked it temporarily so feel free to PM now.

Sent. Thanks.

The below comes from the end of case letter I got from my Solicitor

"The 3 penalty points imposed for this offence meant you had accumulated a total of 12 points for offences committed within a 3 year period and therefore you were at serious risk of a minimum 6 month Totting Up disqualification.

However, after considering the mitigation that I advanced on your behalf and looking very closely at the wording of section 35 of the Road Traffic Offenders Act 1988, the Judge VERY unusually agreed to not impose the minimum 6 month Totting Up disqualification despite you not having exceptional hardship grounds. The Judge agreed to impose a 3 month totting up disqualification on the basis you had only been caught by the totting up provisions by 6 days."

So which bit is the little known legislation? A totting ban doesn't have to be 6 months, and it appears the court used some discretion.

little known legislation with regards to the most recent offence being so near to the time the first points

Please explain in more detail. Either points are counted for totting, or they are not.

What is an ECN?

http://www.knowyourparkingrights.org/News/...arking-ticket#6
You should follow the process as outlined on the ticket received and decide whether to accept the charge or appeal. A discount may apply if you pay or appeal the ECN within a certain number of days. If you decide to appeal, contact the local authority or organisation that issued the ECN. There is no defined procedure, it is at the organisations discretion as to within how many days you should appeal.

To satisfy audit requirements, and to ensure that these are considered consistently, all appeals must be made in writing. Details of whether the appeal can be submitted by post, email or online, should be on the ECN.

Upon receipt of your appeal the organisation will review the circumstances of your challenge against the evidence provided and that obtained when the ECN was issued. The organisation will then decide whether to approve your appeal and will let you know the outcome in writing (by letter or email).

If the organisation rejects your appeal and you would still like to dispute the ECN, the local authority can pursue you for payment through the relevant local courts, such as a Magistrates’ or Sheriffs’ Court where you can further dispute the ECN. The court appearance is for the registered keeper of the vehicle unless they provide evidence of transfer of liability to another party (for example the driver).

Many thanks.

What is the likelihood of not receiving a ban or just the six points and an increased fine given the information above and the 'currently' clean license? Or is it just a case of how the judge feels on the day. I am currently having sleepless nights about this as my world could come tumbling down.

You can't "trade" a fine for points or ban. Fines are income based.

Not the case here.
I am a director of the holding company of the Bentley brand.
We made the vehicle available to the alleged driver as a marketing goodwill exercise. The NIP came back to Bentley and it was apparently stamped with the date of receipt into the postroom, as all incoming mail is.
The mail is stamped without inspecting the contents and is then forwarded to the relevant section.

So just a stroke of luck DB's NIP was held up in the post for 5 days for no apparent reason....

Ridiculous comment.
There is a reason for everything. Just because the reason hasn't been made available to you doesn't justify an implication that there is an apparent reason.
All I am saying to you is that all post received into Bentley's postroom is normally stamped with date of receipt there.
I know of no reason why this letter could or would have been treated any differently.

Rephrased for you:
So just a stroke of luck DB's NIP was held up in the post for 5 days....

Have you CHECKED (not assumed) that:
a) V5C name and address is 100% correct
b) PCN name and address is same as V5C

Have you bought the car recently?

With regards to the contravention - if the bus stop had thick yellow line in gutter, and time plate saying "no stopping", and you stopped in the bus stop, then you're bang to rights on the contravention.

You are questioning whether it is your motorcycle they have photographed. They have asked you to confirm with photos.
I see nothing suspicious so far.
