Hi all sorry was mad and forgot my manners. So I Can't believe they even bother for 4 mph can't remember seeing a camera tbh but will be passing there on thursday again. I've added the notice so let me know if theres a better way foreward. I think I can take the speed awareness but would rather not. Any thoughts? TIA

QUOTE (The Rookie @ Wed, 13 Jul 2022 - 12:50) *
As above, the Police have to send the NIP to the registered keeper. *It was*

The Police had NO WAY AT ALL of knowing who was driving *we know this*

So the DVLA would supply details of reg keeper then they sent NIP to the business address over 20 days late.

We have used this route by a few of us in the office so not 100% sure it was me or staff. I will take the hit if I have to but if they have acted late then I was just making sure of my position.

So far, so good.

"[T]hey" being the police, rather than the DVLA, I assume?

"the business address" being the business address of the leasee (you), who does not hold the V5C and is not the Registered Keeper?

over 20 days late.

I was unaware that there were any legal requirements to serve a NIP after the original NIP to the RK (or driver if they somehow knew who was driving), let alone any required timescale. Please enlighten me.

Some people think that I make them feel stupid. To be fair, they deserve most of the credit.

There is a remote possibility it is and there may be a technical 14 day defence.

As mentioned prevously. I assume this is 14 day period to issue NIP?

How did the police get your details, then?

QUOTE (sugarray @ Wed, 13 Jul 2022 - 10:54) *
DVLA?

Why should the DVLA hold your details in connection with this vehicle since you are not the Registered Keeper?

Yes, you assume correctly. It is only the first NIP (to the Registered Keeper, whoever that may be) that is subject to this time limit. In fact this first NIP is the only one required by law at all. Any subsequent NIPs are provided out of courtesy (and also because they are normally printed on the same sheet of paper as the request for driver's details - as you can see from the NIP you have received).

Since you received your NIP 22 days after the alleged offence it seems very likely that the first one was served within 14 days. The only way to find out is to establish who the Registered Keeper of your vehicle is (i.e. the person or organisation whose details are held by the DVLA and which appear on the V5C) and ask them.

To the RK as held by the DVLA.

It is quite likely they are not even the people you lease the vehicle from since most of these are merely consolidators of some description.

It is possible your details have been obtained from the MIB database if you are the insurers of the vehicle rather than as a result of being nominated by somebody.

I think it may be a bit early for that. The 28 days for a response to the 1st NIP had not expired before the OP got his NIP.
