I am trying to build a library of all the PePiPoo cases that have had happy endings, be it written confirmation or timed out.

Can all users post the link to their (or any other cases they know about) threads so a database can be made up. Once I have a list I will edit this post and update it as and when required.

Not that we get them that often, but when the trolls appear on the site and start having a go, it would be nice to point them in the direction of people who have "had a go" and came out unscathed.

This is what happened to me in court yesterday, i posted it in the members section first


Had a lucky result in Court today.

Brief outline of what happened;

Oct 11 last year i was stopped on the M5 between Taunton and Bridgwater for doing 98mph. The officer took me into the back of his car (i had no one with me to act as an independant witness) ran through what had happened, clocked me with hand held LTI 20-20 then did a follow check(?) where my average speed over 1.5 miles was 98mph.

He issued me with a verbal NIP to which i replied 'i do not understand the significance of those words and wish to exercise my legal right and refer to PACE the police and criminal evidence act'. He did nothing a told me to get in my car and carry on my journey.

3 months later i received my summons and on the S9 statement from the officer on the part where it says what reply did the defendant make he wrote none, lying bar steward.

After a phone call to Mika he said as i had had no independant witness in the back of the police car it was basically my word against the police officers and guess who the mags would believe?. My only option was to go for disclosure of the officers notebook.

After 5 PTR's and adjournments trying to get the notebook disclosed i received a copy of the notebook on the day i was stopped and there was no entry in it stating what i had said.

Had my trial today so on Monday i faxed the Court to change my plea to guilty, so i arrived in court today called into court i was asked to confirm my name and address, the clerk sat down the CPS bloke stood up was shuffling papers for a few seconds then said 'i'm afraid we seemed to have lost Mr. Bulletmagnets paperwork'. After a short conversation between the clerk and CPS bod the clerk turned around and said to Mags that the case against is dismissed.

Result.

I knew i was on a loser when i received the witness statement and the officer lied saying i made no reply, so i decided to give the CPS the runaround as much as i could. Thanks to Mika for the advice about trying to get disclosure of the officers notebook. Never give in and who knows you might get lucky like me.

On a slightly different note, are we sure that this thread is a good idea?

I know that the public servants that we are dealing with have a legendary sense of humour but do you think that we should be rubbing their noses in it like this? icon_wink.gif

Apparently Mr Frampton has deleted me form his Christmas card list. laugh.gif

Success!

Para 4 (it was pre-Mohindra) in Gtr Manchester police (home of the hit & run & perjury & perverting driver PC Tariq Mahmood, who still is a PC).

Much Bluff & Bluster after I returned their NiP incomplete with a letter nominating myself & 3 others: good old Mr & Mrs Hamilton - and timed out 5 months ago :-)

Only just discovered this area. I guess I should add my own five time-outs. In (I think) chronological order:

One was an admitted inconclusive numberplate after a frank denial of the car being in the area (which it wasn't), one was a "failed to recognise the driver" after receiving the photo (this could have been a cloned plate as the front styling was subtlely different too). One was never put forward, despite being stopped, admitting the offence, when I was on the way to my father's death bed on Boxing Day (is there a God after all?), and two... Well, I plead the fifth, as I did at the time icon_twisted.gif

pleaded guilty to 112 mph on the M180

6 points £300 fine. I was happy with that

I should have put these up long ago.....

Two offences on the same day in May 03 (i know!) sent back unsigned NIPs got much B&B letters but just replied with 'I have fulfilled my obligation under S172' and they timed out.

Look forward to adding a third (and after last night possibly a fourth) to the list.

Have it up 'em!
