Also theyre now required to give POPLA codes
So make it very clear that on byleaws land it is not possible for a keeper to be liable, and ther is no legal presumption or assumption that a keeper and owner are the same person. As such the keeper appellant cannot have any liabiltiy and the appeal must be upheld.

Also the NtK still has to have all the required information on it - its not just "anything" that can turn up.

No, not really. I litereally just did so.

The driver plays no part in this. None at all.

The keeper has ticked "defend", ie the person in charge of the car on a day to day basis. The driver can be different to this person, or the same, but importantly the claimant hasnt got a clue who the driver is, and only knows who the keeper is. Unless you directly tell them who the driver was on the day.

And make sure that it is VERY clear that you ar the REGISTERED KEEPER appellant, that there can be NO assumption that the Registered keeper has any relation to the Owner, and POFA is absolutely clear that a Keeper CANNOT be liable on land controlled by byelaws. There is no possibilty that the keeper has ANY liability in this matter, and the appeal must beupheld.

It tells you PE have NO intention of court. They woudlnt send it to a debt collector, they would just go straight to pre-court.

Oh yeah, but that was gone the instant they didnt get a draft order telling CEL to pay up if they discontinue or stay the claim
CEL would never attend a hearing - they made it to a couple and got spanked recently, and havent turned up since to my knowledge.

You respond to the operator - not DRP, theyre just a debt collector - telling them the vehicle has never poarked, and was using the service station to gain access to the motorway

Tell them that their ANPR cameras have had a misread, they have failed to note one or more entrance / exits, and have thus access the DVLA database without reaosnable cause. A failure in their equipment is not your concern.
You can prove the car was elsewhere (I hope so! At work?) in between ... and ... on each occasion, and they have NO prospect of success.

If you recieve a letter before claim, that states they WILL take you to court in X days unless...., then you formulate a strong response

we dont ask things for no reason. This lets you and everyone know what the deadline is.

The next step is that you have told the court you have the claim form, and the claim form tells you to file a defence. So, you file a defence. Show us the draft. 2018 onwards ONLY when you do your research.

DONT PAY YET - almost certainly this is privat eparking, and the failure to record the correctnumber plate means the KEEPER cannot be liable, as there is NO POSSIBLE WAY for them to comply with POFA - as the notice to keeper must exactly repeat the info on the notice to driver, and as the VRM is wrong, it cannot do so.

Redivid missed that the driver was revealed

Only Keepers / RKs have protection or otherwise using POFA. Drivers are always potentially liable.

And, if you ever need to talk about YOUR part in this, you are the KEEPER of the vehicle

The KEEPER performs all takss relating to this PCN - they recieve any letters, etc.
