NIP Details and Circumstances
What is the name of the Constabulary? - Date of the offence: - June 2020 Date of the NIP: - 9 days after the offence Date you received the NIP: - 13 days after the offence Location of offence (exact location as it appears on the NIP: important): - A505 Church Street, East Bound, Dunstable, Bedfordshire, UNITED KINGDOM Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - First If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 3 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - This offence was noted prior to me acquiring the vehicle. I can only assume this was committed by the previous owner at 11:10am. I have purchased and started using the vehicle later that day. NIP Wizard Responses These were the responses used by the Wizard to arrive at its recommendation: Have you received a NIP? - Yes Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes Did the first NIP arrive within 14 days? - Yes Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - No Were you driving? - No Do you know who was driving? - Yes NIP Wizard Recommendation Based on these responses the Wizard suggested that this course of action should be considered:

Was there a bill of sale for the transaction? Whenever I have bought or sold a car I have always insisted the papers be timed s as to avoid issues like this.
Do you know whether the NIP you have is a result of your name being shown as the Registered Keeper or did the previous owner received the first one and name you? If he's named you and then you respond by naming him the police will have to decide what they are going to do. In any case the only thing you can do is to provide the details of the person you bought the car from and add a note that the allegation stems from before you took control of it. So return the form naming the previous owner, whose address you presumably have. It might save further questions if you note that the offence was committed at 11.10am but you did not take possession of the vehicle until later that day so you have named the previous owner.

Was the car purchased from a dealer or a private individual?

I had a similar situation where my car was observed stopped on a red line less than an hour before I got to the dealership to collect it.
Returned the forms with a copy of the purchase invoice and a printout of my oystercard journeys that day, showing that I was on the tube at the time the offence occurred. I received a letter a couple of weeks later saying that no further action would be taken against me. |
