Hi All,
Dealing with this on my dad's behalf and need a little help with what to do next. He received the following last week: Trying to not be too specific, but the offence was on a Friday at around 9:30pm, 30 miles away from where we live and his car was parked up on the driveway at home. My dad has already spoken to the ticket office and they've said the plate appears to be correct, vehicle model and colour is correct, although the image is slightly blurred. They've requested pictures and we're ready to send them off, but what should go with it, a cover letter and the S172? What should we say in the letter, ect? I'm hopeful we can sort this as my dad's car is a private hire taxi with a taxi plate mounted at the rear, but any help is much appreciated. So, what do you need help with? Is the driver known? If youre just nominating the driver then no need for a letter.

My dad's car was parked up on our driveway at the time of the offence, it 100% wasn't him or his car. All I really need is some help in trying to compose a letter to the ticket office stating it wasn't his car, what to say, what not to say. |

The driver of the car with VRM X at Y time was noone. the vheicle was parked up at Z address, as confirmed by ABC person.
Did you ask about the taxi plates showing on the images? You havent mentioned whether anyone did. It would be an obvoius thing to talk to them about, and offer to send a photo in of your vehicle so they can see it, and / or look up their licence no |

We've looked at the images on the GMP website, there's definitely no taxi plate on the back of the vehicle that was snapped by the speed camera.
Will draft a letter up to send in. Should I send the S 172 back too? |

You have to nominate the driver of the vehicle, to satisfy the obligations under S172.
What I emant was, when you called the camera office to say you might have a cloned car, did you not mention the taxi plate?? |

Yes, my dad mentioned to them that the vehicle is a taxi and has a private hire plate mounted under the VRM.
So should we keep the S172 for now and just provide them with a letter and pictures? |

If you are absolutely certain it wasn’t your Dad’s car then you need to state that in a letter, state where the car was, who had the keys, and that no-one was driving it.

And you also cannot complete the S172 of who was driving VRM XYZ at locaiton ABC becuase noone was driving it at the time and it wasnt at that location.
So did the SCP say they could see a hire plate or not? Blood, stone here... |

Will just send them pictures of our car along with a cover letter, cheers. |

You have to nominate the driver of the vehicle, to satisfy the obligations under S172. If you don't know what you're talking about, please refrain from making stuff up. If the OP's vehicle was not involved in the alleged offence, then he is not the person keeping the vehicle that was. His obligation is merely to provide any information that is in his power to give and that might lead to the identification of the driver. -------------------- Andy

If the location is 30 miles away, it's possible that a taxi might have been there at some time |

His car is his family car as well as a private hire taxi and he always takes the taxi plate off when he's using the car for family business. He doesn't remove the plate from the car, he uses either my car or my mum's car outside of work. Thanks for the help everyone, we'll send off a letter with the pictures and see what happens. |

Why send them pictures? I was once told by a former traffic cop "it tis their job to provide evidence to prosecute you, not your job to provide them with that evidence".
Does the OP's father or whoever he was working for have a record of the jobs he done that day as a private hire driver? It is the licencing law that records are kept of all private hire bookings. Local Government (Miscellaneous Provisions) Act 1980-something. |

Because it's likely to stop any further action being taken. Because its almost certain to be a lot less painful to be seen as some cooperative and innocent that perceived as furtive and guilty. In addition if it really is a cloned (as opposed to a misread) plate then there are almost certainly more coming, a letter from the force agreeing its a clone can then be used elsewhere. Is there anything else that is likely to be visible in the camera pictures that may help persuade it was not Dad's car?
Back window stickers, tow ball, missing mudflap, dents ? Even VRM plate itself, flag on blue panel? More the merrier to go with any letter, clear shots of anything likely to be distinctive. |
