Hi
Received a Claim Form in the County Court Business Centre from Excel parking Basically parked only slightly over a parking bay line at end on parking row in a hatched area (i.e not taking up two spaces or posing a risk to other car park users). Never received a PCN or first letter Notice to Keeper only received the final reminder Now have claim form is opinion should I contest and go to court or just pay now? I appreciate any advise is merely guidance. Thanks |

I presume they are after £160?

Give a complete breakdown of the figures
The legal rep would be a box all by itself, and is the allowed costs for FILING the claim. If this is 0, this canot be altered later. Then tell us - date of issue - whether you have gone ONLINE to MCOL to acknowledge the claim? If not, then NOT BEFORE DAY 5 from date of isue you do so, and confirm you have done so, using the instructions found at: MSE Forum - > Parking -> Newbies thread -> 2nd post. |

OK so you do that now, following the instructions on the thread I gave you> THAT THREAD IS GOLD DUST for you. It has *every* step of the process given. YOU MUST READ IT. If you dont, you will likel miss a step, and that can be fatal.
OK so they dont break down the £160 into eg £100 for PCN and £60 for legal costs, or cosats for something else? You still obviously attack this using ythe ABUSE OF PROCESS arguments. |

So I am clear you advise to you do not start AOS before the 5 days so I am beyond that so ok? Also if AOS is made and I get cold feet can payment be settled? Do you think i have a chance here? Many Thanks |

This is wording in Demand for Payment Letter

Yes, pf course you can settle at any time.
Get your defence written, this weekend. Dont prevaricate You do the ONLINE AoS today if you are past the 5 days. This gives you the full l33 days from DATE OF ISSUE - meaning your deadline is? Cool, theyve tried to hide that these are FRAUDULENT debt collection costs - maybe theyre learnning slightly? - because theyve bene *hammered* by some courts. I HOPE you have found the defence and ABUSE OF PROCESS arguments i pointed you at? Theyre really, really key because they show companies losing set asides due to these amounts being tacked on. |

Thanks for response I held of submitting AOS yesterday as wanted to know if could withdraw defence and pay but got to point that I could submit. Will do today Re thread clear on MCOL but will look for abuse of process and post over weekend if have questions Truly appreciate support was ready to give in but you’ve ignited my fire to fight back Thanks Ref deadline must be 30th March if issue date 27th feb |

I have submitted the AOS just now. So assume ok based on Issue date of 27/2/20. I did notice in guidance screenie examples the AOS on that was 2 days after. Anyhow i will examine the threads and incorporate defence. Truly appreciate support. BTW in AOS 'additional contact details' I added my email address but not mobile (excel had my email so thought that was ok). Cheers |
