NIP Wizard Responses
These were the responses used by the Wizard to arrive at its recommendation:
Have you received a NIP? - Yes
Are you the Registered Keeper of the vehicle concerned (is your name and address on the V5/V5C)? - Yes
Did the first NIP arrive within 14 days? - Yes
Although you are the Registered Keeper, were you also the keeper of the vehicle concerned (the person normally responsible for it) at the time of the alleged offence? - Yes
Were you driving? - Yes
Which country did the alleged offence take place in? - England

NIP Wizard Recommendation
Based on these responses the Wizard suggested that this course of action should be considered:
  • The law requires you to provide the information requested in the Section 172 notice within the 28 day period, naming yourself as the driver. If you are considering obtaining formal legal advice, do so before returning the notice.

You should note that there is nothing to be gained by responding any earlier than you have to at any stage of the process. You are likely to receive a Conditional Offer of a Fixed Penalty (COFP) and further reminder(s). If you want to continue the fight, you should ignore all correspondence from the police until you receive a summons. You need to understand from the outset that while you will receive much help and support from members on the forums, you will need to put time and effort into fighting your case and ultimately be prepared to stand up in court to defend yourself.

QUOTE (666 @ Sat, 16 Jan 2021 - 17:28) *
Any particular question?

Hey and sorry yes several questions and advice would be appreciated. I'm fairly new to this as i guess most are, I've not received one previously.

- So the first photo with the speed is from the drivers side of the car - they were on the right hand side of the road (where all the other photos are from) is this normal?

- The road conditions were wet and fairly heavy rain, is this also normal that they operate in these conditions.

-They were positioned on the opposite side of the road facing oncoming traffic firing across the dual carriage way to the lanes 3 and 4 away from them, i was practically in the furthest lane. is this also normal

as with all the details above (ive tried to include everything so as to help analyse and help if possible)

Nothing sounds unusual about the setup and capture. If they can see you, they can ping you.

Indeed, and any angle is in your favour as your measured speed is lower than your actual due to the cosine effect.

So just to confirm its normal that the photo of my car with the speed recording on it is from the side of the carriage way i was on and not where the speed van was located?

The other photos without speed are located from the opposite side of the carriage to the car this is also normal? I'm happy to share if this is of any use?

Post pictures if you want. But as noted if they have line of sight then they can measure your speed. You seem to admit speeding?

Modern cameras have a mode for such weather conditions.

Im not going to lie, it is possible, the road is a 70 mph road with reduced to needless 40 stretch for about 500m no real reasons for it as such (but i understand its the speed limit) before it goes back up to 70

and as i say the primary image with the speed recorded in from the opposite side of the road to where the van was, and the other 2 pictures from the side of the road with the van (as you can see the signpost)

thanks for your replies :-)

All photos will be from the van either the main speed camera or the CCTV style cameras on it.

The 40 limit is there for the two sets of traffic lights at the junctions and the village including church car park and drive entrances. Speed limit sign is quite large and IIRC has a big yellow background (not been past for a while due to lockdown). It is a well known spot for the van to be parked as they see plenty of customers in both directions.

It isn't worth stretching the limits on the A51 even without the vans, too many fixed cameras.

Speeding tickets, like lottery tickets, are a voluntary tax. You don't have to get them.
