I've had a letter from Gladstones asking for £160 regarding from October 2016. I had parked in Oystermouth Square car park (run by LPS) in Mumbles, Swansea with no ticket as the area I parked in was not clearly marked as being a car park. Gladstones have sent me photos of my car parked in the space (I must have only been there 10 minutes) but the photos they have sent of the parking notices at that end of the car park are from 2018.
Where do I stand with this? I don't think it was marked clearly in 2016, but I have no photos from that time proving this. Is it up to them to prove they have the correct signage at the time, or up to me to prove that they didn't have that signage? Thanks, NoMoon |

...as the area I parked in was not clearly marked as being a car park. That sounds a bit flimsy... Do you have pictures to support? Here? -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

and edit your post, do not give any indication as to who may have drove the vehicle.
Refer to "the driver" did this or that. |

I was parked about here:-

How could you miss the prominent sign here?
It's poor signage if as GSV. But they can be litigious so be prepared for that. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver

That sign wasn't there in 2016, it's been added since. But I can't prove that

I did not know you could do that in Street view, very helpful, thanks!
How should I proceed here, just write an email to Gladstones with the links to the relevant street view images and say that it wasn't signed correctly at the time? |

Yes. Send them the picture and suggest that it will be difficult to show that you breached any conditions as there were none there

GS asking for £160.00, how is this made up?
Probably adding the usual £60.00 for debt collection. This is not allowed and many courts have been dismissing cases on this issue. |

This thread was by SchoolRun Mum, may be worth a read on the £60 added on.

The original fine was £85, and someone I spoke to at Gladstones said that they were authorised to go down to £130 if I settled with them there and then.
Should I email Gladstones (I don't have an email address for them), or LPS (I have an appeals address for them, but they have passed this to Gladstones)? I think it's a bit cheeky of them to send me a site map which shows the location of signs that weren't there on the date when I was parked there. |

The difference between planned signs and and actual signs occurs often. You should not be talking to them, you might inadvertantly let slip something detrimental

Just to update this - Gladstones have dropped this and no further action will be taken!
I had replied to them with an email showing the Google maps timelines for the area, after a long period they came back to me using the streetview timeline to show a photo from there that was still 6 months after the ticket, so I pushed back and told them that they couldn't find one before that date, and a few months later they have told me that they had been told that the Client had cancelled their instruction. Many thanks to all who helped me in this thread! |
