I succesfully appealed a moving traffic notice for driving through a pedestrian zone and I thought my experience might help others.

Camden are trialling a pedestrian only zone outside Ackland Burghley school between 3 and 3.30 as I remember. I received a PCN for driving through this area at that time. In fact its very difficult to see the notice as its much higher than usual, 15 feet or so, and has a parking style sign with the operational hours attached. I appealed on the grounds it wasnt reasonable for a driver to take all this in whilst paying due care and attention to the road, especially passing through a width restriction outside a busy school. I took photos at the scene showing that the signs were outside of the normal field of drivers vision. In fact I saw two cars driving through the PZ during the few minutes it took me to take the photo, during the restricted hours.

On the appeal form there was no option for appealing on these grounds, only mistaken ID etc. I decided to appeal anyway after doing some research online. Camden rejected the appeal, and I then took it to the national independent appeal service. Surprise surprise, they mailed me that the case had been dropped as Camden didnt contest the appeal. A letter from Camden followed, I quote, "We are no longer contesting the appeal and we have cancel (sic) the above PCN."

Hope this may be of some use. A friend who worked for a different council once advised me that its often worth appealing PCNs and taking them all the way to the independent tribunal where they often take a different view and you have a fair chance of succeeding with the appeal. It has worked for me a few times, and again in this case.

Please post the London Tribunals Case Number so we can see why the appeal succeeded.

Be aware that adjudicators can only decide on law, they cannot take mitigation into account.

Fine. This thread is really not of much use at all, but I see the OP is a new recruit.

OP, your thread would be a lot more useful if you give more info. For instance what did your appeal major on ? From what you've posted, it seems the very poorly placed signs were the subject. Please post up the reps sent to the council and their response. I assume the PCN was issued by post.

Actually this thread is useful as it indicates Camden may not wish to get their case adjudicated upon so they can maintain plausible deniability.
