My friend parked in a car park behind Aruba in Doncaster this evening and got clamped, the guys were still there, so he instantly paid £120 and got it took off. There were apparently signs up, that we should have noticed I guess, but the thing that I am wondering about is the fact that neither guy had a SIA number around and there isn't one on the receipt my friend got. Anyone know the legality of this? Any chance of taking them to the small claims court and getting his cash back?

Can you post up the receipt (scrub your friend's details, leave the clamper's in). Did you get any photos of the signs, or can you go back and get some?
No SIA number on the receipt makes the clamping unlawful, but let's get as much ammo as possible. You will also need to find out who hired the clampers to operate in that area. Aruba? How did your friend pay? -------------------- Sometimes I use big words I don't understand in an effort to make myself sound more photosynthesis.

If they had no SIA number he should have called the police. Not that it helps you now but if a clamper hasn't got an SIA number or a tow truck hasn't got a VOSA then it could just be anyone going round with a clamp to earn a bit of cash.

Does the receipt say Vehicle Management Direct or Vehicle Management Direct Limited ?
Although VMD Ltd are based in Doncaster they advertise themselves as a ticketing operation not a clamper What did the signs say ? A good rule of thumb - if signs are small and difficult to see, it's probably a clamping trap and unwise to stop long enough to read them Your friend will have to find out who employed them IF they were employed. Start with the Land Registry. This may not be easy because Google Earth shows what appear to be several small private car parks linked to shops If he isn't prepared to go to a lot of work he'll have to put this down to experience. Worth checking though that the clampers are employed there. If not it's a police matter This post has been edited by Gan: Sat, 28 Jan 2012 - 10:20 |
