Hi,

As you have read briefly I was pulled over by police and was shown a radar speed gun and it showed the numbers of 61mph and the officer said that was my speed. Ive had my license for a year but im new at driving and only been driving for 3 weeks or less. The zone that it said i was doing 61 mph was a 40pmh zone. I told the officer that wasnt the speed i was going. He said that it was. He had no video evidence or anything else except for the speed gun. I didnt once admit that i was guilty of speeding. The officer said i will recieve a letter within 6 months and i asked what the letter will entail and he told me most likely a fine and 3 points. I told him again i wasnt speeding and then he just told me to drive safe and went back into his car after he was done talking. Is having a speed gun as the only evidence in court a strong case as he could have measured someone else speeding other than me. And if i do go to court and lose the case will i get more points than the initial amount which was 3 and i already know if i go to court and i lose the case i will get a much higher fine but im willing to risk that and also im willing to pay for a good solicitor/lawyer to help me try win the case. Can anyone tell me all the consequences if i do not win the case because if i do lose the case it will
Be impossible for me to get insured and go to work as i work 45 minutes away in the car and it takes about 2 hours on public transport.

Others will comment but nothing you have said above suggests you have a defence. If you get a COFP ( CONDITIONAL OFFER OF A FIXED PENALTY) take it.
Check yiur policy to see when/if you need to tell your indurers about any speeding offences and remind uourself you are a " New Driver" and there are strictures in the first 2 years of passing your test.

Parked on a piece of derelict land which I believe is waiting for development. It is near parking bays so the parking attendant must be blind to think I was attempting to park within a bay.

I have the parking wardens photos but don't know how to add them to the thread.

Usual requirement is to post scans or pics of wharever paperworkbyou received ( with the usual parts redacted) and the Council pics as well. Use an external host like Imgur or Flickr and post the links starting/ ending [IMG]
A link to Google Stréet View would help as well

I wondered why there were suddenly two big white spaces on either side of my screen.

If I use my ' phone ( Samsung S5) I get the large white area on one side- the right.

I have also written an enquiry to to the Citizens Advice Consumer Service asking for help. They suggest to start an appeal in POPLA.

Did you tell Citz Advice this took place in Scotland -- if you did then they are wrong

Nope. Mastercard.

Chargebacks can be requested for both Visa and Mastercard Debit cards if this is appropriate in your case.

Paid on credit card and a refund via that?
Goods/service was not supplied and I assume you have written proof of the cancellation.

Debit card.

Is it a VISA one ?

No help to you but what a stupid arrangement- why not get rid of the island and just make that a " Bus Stop" with a pull in for the buses- appears to be enough room to do that

You could go online and update the V5C now, any update will be on the PNC Tuesday.

You could leave it two weeks and then call the Police if you know who operates that camera?

Can you update your V5c address online now-I thought it had to be done by post

Good morning,

Last night I was driving back to come back home and my GPS drove me through Coventry city centre. It was almost 1 a.m. in the night and I did not know the road.

So it wasn't last night -it was about 2 weeks ago?

QUOTE (anxless @ Tue, 16 Oct 2018 - 09:00) *
During my morning commute I cut someone up, changing lanes - there was a car behind me pushing and I was approaching the 50mph limit so wanted to pull into into inside lane, but there was a car just ahead there.

So I indicated and pulled into that lane, but then see a car right behind me who beeped a lot, then overtook beeping all the way.

Am I in trouble here? It probably was a bit careless of me, 650-am still a bit dark. Petrified I will now get a nip and I am in the process of switching jobs so worried about criminal records.

Any advice?

Anxious...

Who did you "cut up" Trying to visualise the scenario but just seems like normal on a busy road . If the following car was impatient and couldn't wait until you were able to move over then that's his problem .

Crossing on amber is an offence- the statutory defence is that it was unsafe to stop for some reason.

You can ask for 'photos to assist in identifying the driver' at this stage which may give you some stills from the offence- you cannot request evidence unless you intend to plead not guilty at court.

Thanks.
I tried calling the number (Glasgow transport police) on the paper they sent to ask for photos but there's no response on that number for the last 4 days!
Do I email or write to them? wondering what the normal procedure really

To be pedantic it is British Transport Police . Dunno if theres any alternative contact details on this page . http://www.btp.police.uk/local_btp_teams/s...nd/glasgow.aspx

Let's see if StuBu steps up to the plate to take you through this.

The comment I made to you comparing you to hcanderson was because of the unfriendly way you replied to the OP
I have no intention of offering advice to the OP as others more Knowledgeable can be left to do that but in any event if I do reply to any posters I will do so in a civil manner.

Are the rules any different now?

Yes, insofar as a non-existent entity cannot pursue you, whereas a real one can!

However, do you really think this outfit is going to go to the expense, the inconvenience and considerable costs of pursuing a claim of £100 somewhere in Scotland, some 400 miles (Glasgow) to 600 miles (Inverness) away from their base in Larndarn? They've only ever been to the small claims court twice in E/W - and the cases may have had absolutely nothing to do with parking cases at all.

And here's me thinking hcandersen was Mr Grumpy!!!!!

Going by that video things have clearly changed since I was a regular biker - not least that the "lifesaver" seems to have been abandoned in favour of an unhealthy obsession with the speedometer. I don't recall rushing to report other bikers' minor transgressions to the police, either.

" Let he who is without sin cast the first stone" seems to have been forgotten

QUOTE (Garterman @ Mon, 8 Oct 2018 - 14:32) *
Hello,

A member of the public on a motorbike sent headcam footage to the police of me overtaking him on my mootorbike while he was allegedly doing 30mph himself. I have been sent a NIP for 'driving without reasonable consideration for other users' and am at the point where I need to make a court plea in the next few days.
The video just shows be overtaking in the right hand lane while he's in the left lane of a two-lane road, no lack of consideration is apparent to me and it seems the only suggestion is that I was going over the speed limit. There's a speed figure showing on the footage, which I presume is GPS, which shows him doing 28-31 mph around the time. He looks at his speedo which showed around 30mph too. I don't think I could have been over the speed limit though. Another bike overtakes the same way just before me which adds to my belief that the taker of the video was actually travelling less than 30mph. Is this persons headcam speedo admissible evidence to prove my own speed?

I read somewhere that if video footage is available on social media then it's not admissible as evidence, is that correct?

Thank you for any advice/information

Others will be along to advise but did the registered keepr of your bike get a request to state who was riding it at the time .

One of the flats was smoking.....did you call Fire and Rescue?

Im assuming this isn't a soft top so try Car Polish or T-Cut type stuff then get on with your life. I take it the car was in a car park area...could the fag end have been flicked from the street?

You should not have filled out any section. Its completion is solely the responsibility of the person who it was addressed to but it probably doesn't matter too much.

Thats what I was going to say following on from my Post and the subsequent reply but then I thought...acht feck it - why bother
