So earlier this year I was caught doing 79 in a 70 driving my dad's car. I'm fully insured and had no problems taking the fine, points or whatever came my way. The problem is when returning the form saying I was the driver at the time. My dad filled it out incorrectly and didn't include my address so the form was returned to him. At this point he sent me a photo of it and asked for my address and asked for me to ring them. He thought I was dealing with it and I thought now that he had my address he was dealing with it. Consequently it never got replied to and he has now received a single justice procedure notice for the speeding charge and failure to provide information.
I am wondering how best to reply to the summons. Should he plead guilty on both accounts or should he not plead guilty to the speeding charge since I was the one driving and will the explanation of the situation just being that it was an error on his/my part help the case any? As stated earlier I am happy to take the fine/points for the initial speeding offence. The only problem is the fine/extra points for the failure to provide information could cause problems for my dad if he ends up with them. Will the judge be able to pass these on to me or now that it's got to this stage will he be implicated as the owner? |

So the CPS has until boxing day to issues proceedings against you for speeding. I think you'll need to get in touch with your local CPS because I can't imagine there's going to be a hearing before Christmas?
