Hi all. Sorry to have two posts going at once! But since I've just discovered a CCJ against me I thought I better get advice on another ticket I found on my car back in July.
It was at a pub car park, controlled by PCM, and got a ticket for not displaying a permit. I ignored the ticket and NTK, as stupidly I thought that would be OK, but I now have a letter saying I can now no longer appeal and must pay the £100. What can I do from here? Thanks in advance. |

What can I do from here? Pay it or see if they raise a claim. It's impossible to advise how successful their claim would be without more information... OK thank you. I've lost the original ticket and am unsure where the NTK is but have this latest letter. The pub is near a train station and everyone parks in the pub car park when there's no space in the train car park. The odd thing is that I was the only car that had a ticket. Not a single one of the other cars did. No idea why.
I will try to take some photos of the area tomorrow and post here. What cases are they most likely to take to court? EDIT PS found everything. The PCN was issued 11th July for not displaying a permit. NTK was issued 10th August, and the next letter was issued 11/9. If I speak to them in the pub and appeal to their better nature, are they able to cancel the ticket on my behalf via PCM? Or is it nothing to do with them now? Indeed, why would the pub give a damn?
Personally just hold on, you dont HAVE ot pay anything unless a court orders it. |

Hi all. Just got a letter from Trace Debt Recovery UK Limited saying the case has been passed on to them. I've not heard of them before.
Still carry on ignoring for now? Or is there anything I can send? Thanks. |

There is no debt until a court says there is a debt.
Until there is a debt, there is just a speculative invoice. |

Thanks Eljayjay. I'm just hoping it doesn't go that far.
Out of interest are they out of time at all? The PCN was issued on 11/7, NTK on 14/8 ('date this notice is given'), and a keeper liability letter was sent on 13/9. |

I entirely understand why you say "I'm just hoping it doesn't go that far", but the old adage "hope for the best, but prepare for the worst" is very wise.
You need to read and get a good understanding of Schedule 4 to the Protection of Freedoms Act 2012 (which, if nowhere more convenient, you will find on legislation.gov.uk). Schedule 4 will tell you all about time limits and so on. |

With a ticket o the windscreen, which I think you have, then the Notice to Keeper must be delivered between days 28 and 56 after the event. With no ticket on the windscreen it must be delivered on or before day 14. Yours looks as though they got it correct.
Here's POFA for you. Paragraph 8 is what you want. If you are a regular in the pub then ask the landlord to cancel. Otherwise see if they will take a lower offer. |

Who cares about Trace, or any debt collcetor, for a speculative invoice? Noone here gives a damn about them. All they do is waste paper.

Hello. I've just received another letter from Trace Debt Recovery UK Limited, saying 'please do not ignore this final demand for outstanding payment'. It goes on to say the next course of action will be to pass this on to their solicitors for further recovery action.
Is there anything I can send them or should I just ignore? The signage at the car park was piss poor - very small signs and way too high for anyone to read. They also don't have a period of parking on the ticket. I've searched online but can't seem to find a template response. Thanks. |

what part of "who cares about trace" was difficult to understand?
That letter is a lie. DBA cannot instruct solicitiors, and they dont want to let go of it as then they dont get paid. |

Yep, it's a non-complaint threat of court. Search this forum for the word 'immune' and look back to posts from last month where a letter was adapted each time to suit a reply to Gladstones. Show us your version of that letter.

That's debt collector letter, not LBCCC.

Thanks Jlc - their reference starts with a 1, so I think it's a genuine Gladstones letter. Or have I misunderstood you? |

No it's not just a debt letter.

It's not their normal letter marked as LBC and reference to new PAP.
