Hi all

I received a pcn in the post,date of contravention was 12/11/19 and date of posting was 23/12/19, i appealed online as it wasn't issued within 28 days then they sent this by email,

"I refer to your recent e-mail regarding the above Penalty Charge Notice.
I can advise that the Penalty Charge Notice was not sent out within the correct time frame due to an error that occurred with DVLA. As this was an error caused by DVLA and outside of Medway Council's control, legally we get more time to serve the Penalty Charge Notice by post. Therefore the Penalty Charge Notice is still valid.
If you wish to appeal the Penalty Charge Notice then please submit your grounds for appeal within 14 days of the date of this letter in order for your appeal to be considered at the reduced
amount. Alternately, if you wish to make payment then again please do so within 14 days of the date of this letter in order to be able to pay the reduced amount of £35.00.
Failure to take any action will result in the Penalty Charge Notice to progress on the system and further charges being added."

I appealed again and then received a charge certificate, is this correct? I thought they were supposed to send a notice of rejection with a form to appeal to the adjudicator? I have now received a second charge certificate for the same pcn so confused..have no idea what to do now?

Hi sorry for the late reply, so i received a notice of rejection, they said there was an error with dvla providing the registered keepers details which meant the pcn was not sent out within the correct time frame. They said they first went to dvla on 14/11/19 and then again on 13/12/19 because there was no response. They then responded on 20/12/19, I still have a chance to pay at the reduced amount so thinking i should just pay it? I don't want to end up paying more

OP-----if you've got the reduced rate I would pay up. They have 14 days to submit a request to DVLA and they state that they did so in 2 days. If the data is late they have 6 months to issue a PCN under the legislation.

What reason would the Council have in misrepresenting the facts?

OP, pl just wind back, this is becoming a mess.

You received a postal PCN dated ***;
You submitted reps;
The authority did not respond as required but instead 'gave' you a chance to submit alternative reps after telling you that the PCN was served in time;
You responded to their letter;
They issued 2 charge certs;
They have issued a so-called NOR;
They have not issued an Order for Recovery.

WTF is going on!

We must see what you wrote the 'second' time and tell us how and when;
Pl confirm the dates of the CCs;
Show their so-called NOR.

Do not pay.
