The Driver and Vehicle Licensing Agency (DVLA) breached data protection laws in the way it passed on motorists’ personal details to private parking firms, the UK’s data watchdog has ruled. It could now potentially face compensation claims from motorists as a result, according to one expert. |

Use of the word "Fine" by the ICO;
"disclose this information to car park management companies to recover fines" So the DVLA had the right to disclose the information but they did so using the wrong power. Is that correct? I am not sure what any claim would be based on then. |

I am not sure what any claim would be based on then. The word "fine" is probably just journalistic laziness in not using the correct terms. The KADOE agreement is what controls the data release to PPCs. One point I picked up was that the complainant was saying that the PPC has no right to get keeper details for trespass "offences", as only the landowner can pursue these. PPCs deliberately muddy the waters over trespass and contract breach events, as they know full well only the latter is in their gift to pursue. Use of the word "Fine" by the ICO; The ICO uses the word ‘charges’ in its findings, not ‘fine’. -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

It cost a parking company 2.50 to get my details from the DVLA yet it cost me 5 quid to find out who had requested my details from the very same DVLA,,,,go figure

Use of the word "Fine" by the ICO; The ICO uses the word ‘charges’ in its findings, not ‘fine’. 6 uses of the word fine in the ICO document; 1. They wanted to know the correct lawful basis under Article 6(1) of the UK GDPR for sharing the personal data of vehicle keepers with car park management companies to recover fines. 2. The DVLA therefore thought that Regulation 27(1)(e) provided them with a legal duty to share those details with car park management companies to recover fines. 3. He also does not dispute that the DVLA has a power to disclose this information to car park management companies to recover fines. 4. Regulation 27(1)(e) provides the DVLA with a power to disclose vehicle keeper information with car park management companies to recover fines. 5. Does the Commissioner’s decision mean existing parking fines issued after the DVLA shared vehicle keeper information are invalid? 6. It is not for either the DVLA or the Commissioner to determine the validity of past parking fines. |

Thanks, seems the word search picked up some words and not others. Makes a mockery of their report really.
Also it says they PoFA legitimises the mistake, but if notices then aren’t sent under PoFA…… -------------------- There is no such thing as a law abiding motorist, just those who have been scammed and those yet to be scammed!

I’m constantly amazed at the way some people obsess over the use of the word “fine”. There are few situations where it actually matters.
