Hello everyone.
I recently received a parking fine from PCM, Here's what situation occurred. I'm a window cleaner, i have to unload my van on work days. This one day i was unloading my van and i carrying my cleaning poles to my shed. my colleague told me that a woman all in black had sprinted to my van. i dropped everything i was holding and quickly ran to tell the warden i was unloading the work van. i shouted from my door step what i was doing and she didn't even take any notice of what i was saying. I saw she took a photo on her phone and ignored me and ran off. no parking fine was placed on my Van, or anything to even notify me that i will be charged. One week later i received a parking fine from the PCM in the post. i stood my ground and appealed, but this was quickly denied. That brings us up to present day, i feel very upset by this matter. I'm not the only one on my estate who has been issued a parking fine unfairly. any advice you can give on my situation will be truly appreciated. Thanks for your time Edit: photo of parking sign: Thank you for your reply's. The photo is only of the front of my van, that's what they sent attached to the letter. My back door was open as I was getting equipment out. I was parked across two bays one of which is mine. in front of my home (about 10ft away from my door step). I was approx 10 mins certainly no longer than that. I only had 1 more container of water to get out so would have been like 5 min My back door was open and my street door was open. I was obviously unloading the van. I said to the warden "I am just unloading, I will park in my bay in 5 mins." I was quicker unloading my bloody shopping delivery! if there's anymore info i need to provide let me know. thx This post has been edited by NightOwl1231: Fri, 22 Jan 2021 - 16:08 |

So let's see the PCN you received, redacted of personal details, and photos of any signs in the area.

I saw she took a photo on her phone and ignored me and ran off. Yup, this is how they operate. Finding any way to issue tickets... no parking fine was placed on my Van, or anything to even notify me that i will be charged. They don't have to - the charge can be issued by post. It sounds like they may have complied with PoFA but it also seems you've admitted driving so it's irrelevant anyway. That brings us up to present day, i feel very upset by this matter. I'm not the only one on my estate who has been issued a parking fine unfairly. There's no fairness in private parking charges. They only earn income for issuing tickets... any advice you can give on my situation will be truly appreciated. What is clear is that they will sue you. There's nothing you can say that will stop that. Let's see pictures of the signs. What does your lease say? Also, have a read of Jopson and the information here. Can you give more details about where the van was parked? E.g. is it a block of flats (one of which you rent) with parking bays for the tenants? And was the van parked in a bay or on the roadway or ...? Etc etc. The details matter.

The infamous toothbrush case may also be useful in this case?
For the benefit of the OP PCM will reject any and all appeals and the IAS will also reject. |

Thank you for all your reply's. The photo is only of the front. My back door was open as I was getting equipment out. I was parked across two bays one of which is mine. I was approx 10 mins certainly no longer than that. I only had 1 more container to get out so would have been like 5 mins. Many thanks.
also just to add. My back door was open and my street door was open. I was obviously unloading the van. The photo on the charge only shows the front of the van. I said to the person I am just in loading. I will park in my bay in 5 mins. I was quicker unloading than my shopping delivery! |
