What is the name of the Constabulary? - Date of the offence: - August 2018 Date of the NIP: - 6 days after the offence Date you received the NIP: - 8 days after the offence Location of offence (exact location as it appears on the NIP: important): - A50 (Temporary Road Works) Uttoxeter, Staffs (1223) Was the NIP addressed to you? - Yes Was the NIP sent by first class post, second class or recorded delivery? - First If your are not the Registered Keeper, what is your relationship to the vehicle? - How many current points do you have? - 0 Provide a description of events (if you know what happened) telling us as much about the incident as possible - some things that may seem trivial to you may be important, so don't leave anything out. Please do not post personal details for obvious reasons - A50 Dual carridgeway heading into Uttoxeter from S-O-T, proceeding to slow down to 50mph for road works. As I got closer to a overhead bridge I noticed the camera and operator both hidden crouched down under a coat with the lens pointing out from beneath the coat. Never seen this kind of behavior before. Camera to car was 480m so not sure If I had reached the speed limit as the picture they provided at distance is near useless. They should have measured the distance from camera to signs before starting enforcement for the day.
In any case, the struggle you will have is you were still over the speed limit assuming you were still on a duel carriageway, so 74 is still above the limit. I'm presuming you just driving a car and weren't driving with a trailer or anything? |

That excess just qualifies for a fixed penalty, 3 points £100. Seems best to accept that?

I noticed the camera and operator both hidden crouched down under a coat with the lens pointing out from beneath the coat. Never seen this kind of behavior before. Maybe having trouble with sunlight/glare .... whatever the reason it doesn't help you. Hidden Camera ...ACPO guidelines would appear to say otherwise and I've been on the Staffordshire NIP page and there's also no certificate of calibration for the device an LTI_20_20 Trucam. There was also no vehicle on the bridge, just the hidden operator and his camera. This wasn't sun glare but a deliberate attempt not to be noticed from a distance |

What effect on the law do you think the (now defunct) ACPO guidelines would have? Noting that guidance was to ensure operator safety anyway.

ACPO guidelines would appear to say otherwise Guidelines are nothing more than guidelines. there's also no certificate of calibration The police have told you that? Or are you just guessing (not that it would automatically dismiss your reading in any case) There was also no vehicle on the bridge, just the hidden operator and his camera. So? The problem is even if it was hidden that isn't a criminal offence, whereas speeding is. So proving it doesn't help you, unless it meant they were do hidden that it seriously affected their sight.
Spotting any one, even a Mr Blobby policeman, is difficult from 0.5km away. |
