Box Junction Penalty

Hello Forum,

I’ve received a penalty notice, in a no stopping zone minutes away from my home. I’m very familiar with this zone. However, the activity on the roads were out of the ordinary on the day in question, and I got stuck. I’m not sure if this is worth contesting. However, I thought I better plea my case on these forums before I make my appeal.

As the photos show the Lane ahead was clear for cars. The traffic from the lane to the left had veered slightly towards he centre, as there were mostly like parked cars blocking the flow ahead (it may have been roadworks, I cannot recall).
The car I was following abruptly stopped just after the no stopping zone, without indicating, attempting to steer into the central lane of traffic. Despite my hooting he refused to make the small space I needed to be clear of the zone. As I eventually passed him I noticed he was an elderly gentleman, and perhaps did not notice my dilemma or the subtle honk of my horn.

I have driven this road uncounted times over my 15 years in the neighbourhood. In the case of parked cars or roadworks motorists stick to their lane and indicate into the right line at the first chance available.

As the photo shows the driver ahead has ample room to clear the way. I am aware that is beside the point and I still got caught in the yellow zone.

There is a right turn available on this road. Despite being caught in the zone i did manage to keep the car moving very slowly. Should I request a copy of the video evidence?

Any guidance whatsoever would be greatly appreciate.

Only way to judge this is to get the video on DVD from TFL. call them and confirm it will be on hold (usually for at least 14 days after it arrives).

I think you are going to struggle with this one, you drove right in behind another car without any sort of check and what you did is what the box is designed to stop. Pay the discount

Regardless of the driver in having space in front of him to let me through?And the traffic from the left lane veering towards the Center?

I agree with PMB, barring a procedural cock-up from the EA I don't see you getting out of this one.

EA = enforcement authority = council

I agree with the others - pay discount. Other drivers should have used the bus stop to merge in and give more space but I expect they were concerned about a PCN for bus stop stopping... or even red route. You could have nipped around the car ahead as there was no oncoming traffic - you have to think quickly and get out of the box by any legal means. Or maybe turned right or left.

Thanks for all of your responses.
I figured I’ll try to make an appeal, despite the low chance of success.
It would give me a bit of time to pay in any case.
Are there any grounds upon which I could base this at all? What would be my best shot?! Or is it totally hopeless?

What you have to bear in mind is that TfL do not have to re offer the discount, though experience tells us they usually do.

You can try appealing to their better nature, explain how the traffic from the lest starts to move over and that the car in front of you was over cautious leaving you stranded in the box. It was unintentional and brought about by somewhat aggressive driving by some of the cars in the left lane, would they please consider the circumstances and use their discretion to cancel this PCN
