Speeding - exceeding speed 30mph on a restricted road

Hi

I was in middlesborough doing drop offs and I was in and out of B1380. Some section of the B1380 used to be restricted to 40 and 30 but in august Middlesbrough council granted that the b1380 to be restricted to 30 which I found later after receiving the NIP.

As I don’t reside in Middlesbrough I didnt see the any signposting for 30mp, I was at the end junction of Burchington Avenue joining B1380. I took a left to get onto B1380 and it’s a short strip before hitting the roundabout.

Unbeknownst to me I didn’t realise that there was a mobile speed van and been caught doing 38mph.

Is there any grounds to appeal ?

There is an expectation that when a speed limit is reduced sufficient notice is given to warn motorists of this.
In your case, as 5 months had elapsed, I don’t see that you could ‘appeal’ this, but if you qualify, you should be offered a Speed Awareness course rather than a fixed penalty.

Presumably you understand that if it’s a restricted road the only 30 signs required are at the start of the limit, there is no need for repeaters throughout the limit and in fact they aren’t permitted (but a 30 roundel can be added to a camera warning sign).

No grounds at all, I'm afraid. Birchington Avenue is very obviously 30mph and there is no sign changing that as you come out on to the B1380, what's more that was exactly the same back in 2009 which is as far back as Google Streetview goes (LINK) so you have not been caught out by a change in speed limit last year.

You should get the offer of a course provided that you have not done one for an offence in the 3 years prior to this incident, otherwise it is £100 + 3 points.

The B1380 is a long strip and its signed for 4mph at the entry of B1380, I only use the B1380 to get on and off nearby junctions, i must be getting off before seeing the 30 sign is posted. So there’s no way of me knowing that it’s 40

Apart from the fact there are streetlights and no speed limit signs indicating any other limit, so it's a restricted road with a 30 MPH limit.

If you got off before the 30 signs then you were still in a 40 limit obviously.

Go back and check the signage, but I think you’ll find you are mistaken.
