Or is it? Whiffs a bit of another grey area. Using a mobile contactless payment system (Google Pay, Samsung Pay, Apple Pay, there may be others) does involve holding the phone. But it's not "providing access to the Internet", nor sending or recieving images (still or moving), a facsimile, or oral or written messages (it's exchanging a payment token with the PDQ machine). And the "Proper control" angle doesn't seem a problem either; as in the normal course of events, the parking brake would be on and bags of food/handfuls of cash/a payment card would be being handed through the window. Unless one has been doing it wrong, and the correct approach is to sit a passenger in the back seat and leave them to deal with the drive-thru stuff while the driver remains sat with both hands firmly on the wheel at all times? |
