Hello
I'm really sorry if this is dealt with elsewhere but I've had a quick look through and can't find anything wholly relevant. My wife received a letter from Coventry City Council Parking Services Payments stating that we hadn't paid a PCN served on 26/07/2012, the day I drove my son to see an Olympic football match. I got back to the car after the match and there was no ticket on the screen. We are now told we must pay £70 as the deadline for the 50% off has been missed. I was slightly confused by this and so drove to where I had parked to check for parking signs or road markings. There were none on the road but there was a large sign which said there were restrictions in place in times of an event being held. Fair enough as it is quite large but I must say that the positioning is not great as by the time you have negotiated the 3-way junction and driven into the road and avoiding road users, the sign is pretty much out of view and so I left the car on part of the road which looked clear and ok to park. There was lots of room. 1. I'm reluctant to pay anything but.. 2. I am willing to pay the 50% if need be but where do I stand now? |

OK, so whilst you may have parked incorrectly, but we dont know as the PCN was not served as far as you are concerned, so that is the first appeal point on the NTO document. I assume this is what you mean by "letter" from Coventry CIty Council. They then will have to prove in their response they served it if it gets to adjudication. Others on here are more expert than I on such cases, but if you don't get the PCN, how can you pay the 50% amount ?

I had this posted to me on another forum "It is unlikely that the Council will re-offer the 50% penalty at this stage, highly unlikely. So forget that except to include in her appeal wording a line which states you are willing to pay the 50% just in case they settle at that. Do not just fire off an appeal that says 'there was no PCN on the car'. You will lose." Comments? |

*bump* I would really appreciate some more advice or clarification. How shall we proceed in order to have it reduced back to 50% without saying there was no PCN?

Unfortunatly the council are pretty much never going to do this. Thus you have nothing to lose by challanging this one all the way to adjudication! |
