Traffic offence report - no details

Hi - my son was stopped by a traffic car who said he’d driven past him at 70mph, although they did not have him on camera or follow him at speed. He say’s he was doing 60, and did actually tell the police this, but they said it was more like 70. The copy of the traffic offence report is not readable as the carbon hasn't worked properly. Is this a defence? I’ve tried using the NIP wizard but don’t understand which answers to select - he has received a letter from the police saying it will go to court.

All views appreciated please!

Over 50 (55 in some areas) in a 30 limit, or over 25 over the limit for higher limits, will send the case straight to court. An illegible TOR is no defence as there is no requirement to give one. The evidence of a single officer would not be sufficient (except on a motorway) unless he is reading a measurement device. Your son should not expect to hear from the court quickly, they have 6 months and usually seem to take most of this time.

I'm not surprised, as he hasn't received a NIP (and s172 form) - they weren't required as he was stopped at the time and given a TOR.

The TOR being unreadable is not a defence at all.

Until about two years ago TORs didn’t even exist, the police introduced them to streamline their own process and give a copy to the accused as a courtesy.
