What costs do you have at the moment?
It would only be your time taken so far. But as pointed out, you wont stay on SJP - once you submit not guilty (or whatever it asks) you move onto the normal Mag track. And, Ive told you about costs there.

You have no costs to speak of with SJP. No hearing and you dispute it, so they cannot continue iwh thte SJP route.
Costs can be applied for at any hearing.

c) In any case, on the assumption that the claim relates to failure to pay, the driver at the time did indeed make payment, and this payment can be proven.

There is no "leaving it at that"

If the court does NOT agree you will be required to attend a hearing. SJP only works for "guilty" pleas (in the real criminal world) and denying the claim should result in it being transfrred to the magistrates.

You always defned on signs, amount is a penalty not saved by Beavis, no landholder authority and No POFA compliance so no Keeper liability. Thats everywhere.

Continue to prepare for court, of course you mention that the claimant has already settled the claim, and continuing to the hearing is an abuse of process.

Did you send a defence in as well, or did you entirely rely upon not knowing about the claim?

THere is no otehr avenue of appeal. Pay or not, the CCJ will remain for 6 years.

OP - what have *you* done to work that out or not?
Its not good standing up in court and saying "well, the internet said.." when you are *perfectly* able to read and understand PFOA 2012 schedule 4 para 8 (if there was a windscreen ticekt) or 9 (if there wasnt)
Do that, then ask.

You CAN be taken to court> anyone can take anyone to court.
There is not a "high likelihood" as they dont take even a small proportion to court


If you pay it youre helping them fund other scams against people who might not be able to pay. If you can live with that, pay.

You absolutely use the fact that EXCEL have used RINGO as their agent, and are *fully responsiblee for the actions of their agent* - Law of Agency.

Their Agent told you what to pay, you paid it, end of. THeir fault if their agent cocked up.

It is not POSSIBLE for a company to drive!

Yes its up to them to prove the driver was the keeper. If you can prove otherwise its an easy defence to write

Not sure section1 0 applies since the new DPA2018? Just invoke your "right to be forgotten" as their Penalty Notice was merely an invitation to settle without prosecution and as there is no linger any chance of prosecution, and refusing their request cannot possibly create any civil or criminal "debt" for them to pursue, they no longer have cause to process your data, and it MUST be erased.

It was the weekend!

Give people chance!

1.1.2 - did it arrive within the timescale? If not, then mention it. If yes, then its irrelevant. You dont deny this part.

3 and 4 both mention that there is no detail of what the breach was. Dont mention it twice.

5.1 - does this mater? Wa the claim from before or after this date?

6 - dont add that in, unless youre going to put it with the Greenslade section. Its just stuck out by itself

7 - so are you saying no NtK was ever received? If no NtK was received then tehre is no liability under POFA.

What happened to 8 - 11?

13 - expand on this, splitting the two sentences into two para.
SO 13 "original" - POFA limits the liabilty to... This claim includes an additional £60 for which the claimant is aware they have no right to claim, and it is inconceivable that the claimant is not aware of this. Claiming an amount which the claimant is aware is not owed is an abuse of process, for which a common sanction is to strike out the whole claim
New 14 - the £60 additional amount appears to be for "debt collection" costs, however it is averred that these costs were never incurred as their debt collector operates on "no collect no fee", and thus the claimant is not entitled to add this amount on as it is not oweed by anyone, driver or keeper. <then repeat the same line about abuse of process>
