Hi,
The Scottish government seem determined to inflict KL on motorists here. Can you please sign the petition below, even if you don't live in Scotland, thank you.

Signed.
Reaon given is that the imposition of a contractual condition on a non contracting third party would be unlawful without the Protection of Freedoms Act.
It should remain that way

Murdo Fraser (a Tory MSP) is well known for this type of ‘fair play’. I responded to the consultation back in 2017 and heard nothing more. It didn’t make it to the 2018-9 programme of Bills, and I doubt it will make much headway in 2019-20 as there is much more important business to address, but we’ll know more come September.

Keeper Liability in England and Wales was compensation to the parking industry for the clamping ban

Scotland simply called the practice extortion

If it's introduced in Scotland, Mr Fraser shouldn't be surprised when somebody decides that the easiest way to dispose of an unwanted vehicle is to transfer the registration to him and, after waiting several weeks for the DVLA process, leave it in a suitable car park

There's another way too.
Wonder what his registration number is?

This has now passed.

The final version of the bill is at: https://www.parliament.scot/S5_Bills/Transp...l33BS052019.pdf

Part 4B introduces keeper liability.

For ease of use, that starts on page 90 of that linked PDF.

Do we know when it becomes 'active'?

this bit is scary

2) It is immaterial for the purposes of this Part whether or not the vehicle was permitted to be parked (or to remain parked) on the land

so no "the signs were forbidding defense"

If it is a works car park that is licensable, would that satisfy a statutory control.

If it only makes a keeper liable for what a driver owes though, it will still be relevant, it’s just for the purposes of ‘this part’.

I believe this act received Royal Assent in October 2019. Does anyone know if keeper liability is now in force in Scotland or not ?

Doesn't look like it - I can only see one Commencement Order for this Act so far, and it didn't cover the relevant part.

In addition the relevant requirements haven't yet been published, so while it's possible a random PCN may comply it's unlikely!
