Hi all,

Not necessarily a request but wanted to post this in the event people have a similar issue.

I received a Court proceedings notification around 4 weeks ago with regards to the apparent issue that I had previously received notification from Cambridgeshire Police of a speeding offence (81 in a 70) on the A14 towards Norfolk.

I had not received this notice, however the court documents included 'evidence' that I had also received this notification in December 2019 and therefore I was also liable for an MS90, which in essence is failing to reply to a notice that had been issued, even though I had never received such a notification. I had been driving on the road at the time but had not received any notification until June 2020.

I did a bit of googling at the time which basically showed a few people who had been given 3 points for the speeding fine and an additional 3 points for not responding which I felt was entirely unjust.

I responded to this notice and plead guilty to the speeding but not guilty to the MS90, but this worried me still as after reading further, there is no burden of proof on the police to demonstrate that any paperwork was received by me, only that it was issued by them.

This morning I have received the results:

  • SP30 - £230 fine + costs of £90 and a victim surcharge fee (not sure who the victim is!)
  • MS90 - Dismissed (no evidence offered)


A fairly hefty fine although I'm feeling more relief that the MS90 has been dropped - thought this may be useful for people in a similar position.

We are very familiar with this.

You were lucky as you could have ended up on 9 points (failing to furnish is 6 points not 3) if they had chosen to progress the S172 offence (MS90 is the conviction code, not the offence) as we have seen happen to others.

Why you didn't get the original notice or any reminder you've not mentioned.

I appreciate where you're coming from - but I'd have felt more unlucky if that was the case as I hadn't received the notification, otherwise I'd have just accepted it as I was clearly the driver at the time of the offence.

Would be worth checking the address on the car log book is correct
