Hi All,
Please can someone help. I have had a fine for traveling in the lez zone in a minibus LT46 Volkwagon. Now the minibus only has 3 seats as it's used as a show vehicle and not for transporting people and the fine has come in at £1000 reduced from £2000 if I pay within 28 days. Since having the fine I have contested it with TfL for being charged the wrong amount as I know my minibus is way less than the 3.5 tonnes fine that they have issued. TfL does not agree and has asked for evidence so I had it weighed at a Biff weighbridge and it came in at 2660kg. The V5C does not show any weight and there is no vin plate on the bus showing the weight either which I have told TfL. I sent photos of the weighbridge cert showing 2660kg and an image of the minibus being weighed with the weight showing on the cert and on the digital screen on the weighbridge. TfL will not accept the weight and has said they have confirmed from VW that the GVW weight listed is 4400kg and they will not reissue the fine at the lower price or cancel it and have said I can appeal to the adjudicator within 28 days. Can someone please help with this? Thanks in advance. |

If there are no longer 9 to 15 seats, the vehicle is no longer classed as a a minibus. That is what the OP could have problems with, it has been stated that at times there have only been 2 or 3 seats, at those times the vehicle would not be considered to be a minibus.

That is what the OP could have problems with, it has been stated that at times there have only been 2 or 3 seats, at those times the vehicle would not be considered to be a minibus. On the day in question, it had more than 9 seats and I have images that prove it so it does get classed as a minibus in that instance. |

That is what the OP could have problems with, it has been stated that at times there have only been 2 or 3 seats, at those times the vehicle would not be considered to be a minibus. There are dozens of websites that refer to removing seats from mini buses including companies whose business is mini buses. For example BVRLA "It is possible to remove seats from a minibus however, temporary removal of seats does not change the classification of the vehicle therefore there are no legislative benefits to removing seats. If the removal of the seats is on a permanent basis, the minibus should be reclassified with DVLA". |
