Thanks for letting me join.
In Oct. 2017 a windscreen Parking Charge Notice (PCN) was stuck to my windscreen by A S Parking at Rock Quarry Car Park Rock, North Cornwall. The land owners are Prince Charles/Duchy of Cornwall who lease this land to Padstow Harbour Commissioners (PHC). PHC are governed by Bylaws, but I have been unable to find out if this leased land is covered by their Bylaws and thus not relevant land. Having checked with the Duchy, A S Parking do NOT have their authority to make a claim against me even though they have threatened litigation through the County Court. Can anybody advise please. |

Yes, they have 6 months to lay the charges before the magistrates.

A penalty notice issued under the byelaws is enforced by the magistrates and the information must be laid within six months
A parking notice issued under contract law is enforced in the County Court and the claim must be brought within six years The only significance of "relevant land" in the second case is that the parking company doesn't have the right to recover payment from the keeper unless it can show he was more likely than not the driver IIRC the issue in this particular case is that AS Parking doesn't have the authority to issue Parking Notices or, at least, doesn't have the authority to take legal action |

I have been going through all the paper work connected to a parking charge notice from October 2017. A S Parking is the delightful company I am dealing with. The ticket is for 1 hour: 16.37 to 17.37. There is a grace period of 10 minutes, logically bringing the time up to 17.47.
A S Parking have called the 17.37 for "observed time" and 17.47 as "issued time" This maybe nitpicking, but should not the issue time be after the end of the grace period time? |
