Question regarding the start time for the 14 day NIP Options

I MAY have been flashed today on a 30 road doing around 35 by a GATSO. I wasnt intentionally speeding or anything, just not an area I drive in much and recently got a new car. However, it might be possible that the flash was for the car infront. When it flashed I had just gone over the first few lines on the road when I looked at my speedo. I think the car infront was also on the lines.

I know I have to wait 14 days to see if anything came but just wondering when that starts. Would it be 14 days from today or tomorrow?

Also, is it possible for a GATSO to flash and no NIP to ever come through?

A NIP must be served upon the Registered Keeper of the vehicle within 14 calendar days of the alleged offence. And the date of the alleged offence is Day 0 (ie not included).

I'm in a similar position and today is the 19th day after the alleged offence still heard nth from the police.

You'd probably post the details (and question) in your own thread..

But the requirements of service of a NIP are provided by s.1 Road Traffic Offenders Act 1988. And if the court finds that these requirements were not satisfied, then this would should be a bar to conviction (of any person) of the offence to which the NIP applies.

NIPs 0 - Flashes 4

Could be out of film, could be a dummy unit designed to scare people (works!) in which case the 'flash' speed threshold is usually lower than that for a real camera, typically right on the limit.

As I got the Logbook the day after Day 0, does that still apply? Surely the ownership details will have been updated by they day it happened.

Today is the 14th day and no post has come through. Is it safe to assume that I am in the clear?

Regarding the logbook issue, as Ive already mentioned, I got the logbook on Day 1 meaning all the details would have been finalised and the logbook posted on Day 0. Because of this, the 6 month rule doesnt apply does it?

The six months rule still applies, but the 14 day one might not, as far as you are concerned. It might, though, still apply to the previous RK.

The V5C that was delivered to the OP on day 1, and therefore must have been posted on or before day 0?
It is probably safe to assume that it was printed before it was posted, and that the DVLA's records had been updated by the time it was printed.

It is technically possible that, if the DVLA database was updated on day 0, the camera could have been unloaded, the film processed and a request for RK's details made to the DVLA, before the database was updated, but I somehow doubt it.

Sorry but Im not comfortable with posting the V5C doc ref. Probably harmless posting it but Im not sure so I would rather not post it.

However, inside the booklet, on the 3rd page the doc ref is printed. Next to that is the date 08/06/09. Is this possibly the date that the details were finalised? The incident took place on the 10th June, 2 days after that date. Also it happened in the evening, by which time post is usually sent out. I doubt they would have been able to process everything so quickly.
