Wrong Contravention Code, Sign not clear for time restricted no left turn

Hello all,

I've received a PCN with contravention code: 50R for turning left into dryburgh road from Upper Richmond Road in Putney. I commute from Surrey to Putney and new to this area. When I was travelling on the upper Richmond road, my gps showed me to turn left on dryburgh road and there was this inclined electronic display for no entry in the corner of dryburgh road. I hesitated for a minute, but there was no clear sign of time restriction on the electronic display and since it was inclined to certain degree, it was not clear which turn it was for. Only after receiving PCN and some research, I came to know about the no left turn entry sign with time restriction which seemed to be set far back on the upper Richmond road looking at the google maps. In my opinion, this sign should have been closer to the corner of dryburgh road.

Is it worth appealing on the basis that the signs were not clear or for wrong contravention code 50R instead of 50L?

upload the remaining pages, if you run out of space use imgur.com and post a link. Also give us a link to the location on Google Street View. If the images on Google Street View are out of date, you will need to take pictures of the signs.

In the meantime call TFL and ask for the video, they will put the case on hold and send it on a DVD.

I make representations against the imposition of PCN number xxxxxxxxxx on the basis that the cited contravention of a prescribed order did not occur.



The enforcing regulations The London Local Authorities and Transport for London Act 2003 at regulation 4(8) lists all the mandatory information that must be contained within a PCN.
At 4(8)(a)(i) the PCN must state " the grounds on which the council or, as the case may be, Transport for London believe that the penalty charge is payable with respect to the vehicle;"

This PCN states contravention code 50R (this code carries no legal weight.

The PCN then goes on to cite the contravention description for which a penalty is demanded this being Performing a prohibited turn (no right turn).

Examination of the CCTV recording confirms that I did not perform the cited right turn. As such the contravention did not occur and no penalty is due.

I look forward to confirmation of cancelation at your soonest convenience

FTFY, but +1, a contravention might well have occurred, but the contravention alleged on the PCN clearly did not.

Your first mistake was relying on GPS (SatNav) and not using your Mk1 eyeball.

They maintain you made a right turn. If they cannot evidence this they lose,

Yes I do missed the temporary time limit sign board which was behind the speed camera...

but they repeatedly saying that I did right turn. When the specified road was on my left hand side...

I will try to get the video... if it is clear that I did left turn do I still have a chance to win this in my further appeal?

If you turned left, the only way you could lose would be a complete disregard for the regulations by the adjudicator

If the video footage shows you actually turned right after all and not left then probably pay it if the discount is still available.
If you did actually turn left then appeal.
