Don't know exact PCN dates yet as couldn't reach traffic enforcement
my wife thinks they will be for driving the bus line in January in Colchester high street

The amounts match a bus lane.

Can you see any dates, using the references, on the Council website?

Im asking if i can appeal against the parking.

YOU can't do anything. You don't have a PCN yet.

Sorry, I don't have the patience tonight: I'm sure others will explain.

Hang on.
Is the address Enterprise have for you 100% correct?

You don't have a PCN (yet).

Read the first main paragraph.

QUOTE (PASTMYBEST @ Mon, 15 Oct 2018 - 20:08) *
The 8 rather than 8 am has been adjudicated on before and won, just not sure that would be Newham's case

I think the real problem is that regardless of the rights or wrongs of the case, the adjudicator is going to see a dodgy permit and refuse the appeal.

There have been some peculiar adjudications and failures by Newham to present appropriate evidence.
One case on forum, clearly a re-used vp, made it past the adjudicator.

Newham shout " 'tis so!" and some adjudicators have said 'well I can't see it'. All Newham had to do was show an
appropriately adjusted image (that's what I do for all of them and it takes 30 seconds)
Albeit, in this case, that's hardly necessary -- ah, but what pics do they have - unlikely as clear as the one posted.

I gurss it's possible that an adjudicator, unimpressed with the draconian tow (Mick & PMB), might choose to blink at the wrong moment?
Or even decide the greater of two evils?

Also it's an 'All Day' as opposed to a '24 Hour' permit. Valid until midnight on the marked date. So it shouldn't matter what time it says. It must always have been within the time.

I can see most of us would think so but, in response to enquiries made by a local Councillor, Newham confirmed they covered 24 hours.

That said, I've always been dubious about it myself and wonder if it's written anywhere in TMOs or other
relevant document?

---
Having said I have no sympathy for the apparent 'cheating', we mustn't lose sight of the fact a valid res permit
was also in play, just not displayed.

I have no sympathy as this re-use cheating seems a widespread local disease.

But I'm equally miffed with the way Newham are fighting it.
QUOTE (Enceladus @ Mon, 15 Oct 2018 - 15:01) *
An all zone visitor permit was displayed. Arrival time "8" and completed for 20 Sep 2018
Zone hours are 8:00am to 18:30pm, Mon-Sat.
09:38 PCN issued, code 19.

The 24 hours could start at 8am or 8pm, hence their secondary reasoning.
But they rely on a presumption of future contravention, i.e. that the user will attempt to park
for 36 hours.
But at the time PCN was issued, that had not yet happend: The vehicle cannot be in contravention at 9.38am on that score.

It could only be in contravention at 8.01am on 21st and only if noted present before 8pm 20th.

Newham should not be penalising for something someone might do.

However there is also a scratch on the visitor permit on the number 19.

It appears used 15th and 18th too, just from first look.

On what basis would they cancel it?

And what exactly are you saying to Ealing in your proposed e-mail?

I thought about going more aggressively towards the Hire Co.

No.
We're trying to explain that the address (223) they used wasn't wrong; it was all they had.

The 194A/B issue you've picked up on is not directly relevant to the application you are now writing.

So your general 'flavour' of your application can only now be that it was 'unfortunate' that you moved
during the progression of the PCN.

---
Questions:
Lambeth e-mailed you on 3/10/17. How had you contacted them ?
Did you give them your new address in your message?

the hire Co. had requested transfer of liability which was rejected at first by Lambeth on 06 July 2017 and when the liability was finally transferred

Have you found out for sure that liability was transferred?
I've assumed so because it's the only thing I can possibly think has happened.
But as Lambeth told you not liable, back in October 2017, I think we can improve this bit.

As for now I've moved my car into my gated back garden due to the fare of being clamped on my drive

Nothing we've seen or you have said indicates that is anywhere near likely.

QUOTE (AAAmellow @ Fri, 12 Oct 2018 - 19:21) *
where do I stand if there is a current OFR issue in my name (to whatever address they hold)?
You can make a Witness Statement, immediately, to reset the matter. You do not have to wait for the OfR BUT, if so,
check what address TEC have on record.

And where do I stand if there isn't?
Recheck in 12-15 days - but don't forget.
I will be using Monday as an emergency annual leave to sort this out or at less getting the ball rolling.
Wasteful: It's a 30 second phone call (sometimes 20-30 minutes in queue) then, maybe, a tick-box form.

Your call to TEC is as simple as - they'll immediately ask PCN number. If they don't recognise it the debt is not
yet registered. Recheck once to ensure correctly heard.
Don't go "in depth" on anything; they have no time and others are waiting in the phone queue just as you will have done.

I don't mind your desire for detail but members here are mere humans with lives to live. We can't repeat the detail, for
every individual, that we've posted hundreds of times before. No one will advise, in the shorthand we have so far, if they are
not 100% sure. Any erroneous advice is quickly addressed here.

Sorry Vauxhall.
I'm really really struggling for time.

I hope others help you out.

But some brief input -
QUOTE (Vauxhallondon @ Thu, 11 Oct 2018 - 15:49) *
I had no knowledge of this matter until received a notice of enforcement handed by my neighbour. (My address still wrong despite had been updated on 17 September 2018)
I did some research on the matter and found out that the PCN was issued on a hired car, the hire Co. had requested transfer of liability which was rejected at first by Lambeth on 06 July 2017 and when the liability was finally transferred Lambeth had the wrong address despite have myself on council tax with the correct address sense may 2017.
Therefore giving the miss communication between hire Co. and the council I have had no earlier opportunity to file a statutory declaration
I’m confidente that the court and the enforcement authority will recognise that this matter has resulted from a miss information given by a third party , neither me or the enforcement authority are at fault
I respectfully request that I now be permitted to file this statutory declaration so that I may settle the matter promptly

And as evidence I'll send a PDF of my renting agreement

The red bits delete.
Concentrate on the 'statutory notices being sent to the wrong address' and apparently Hire Co at fault.
Give both addresses so they understand. Be clear which is correct.
