Hi
Im a licensed hackney carriage driver. I was issued a pcn via the post for a contravention that has been stated as the following Vehicle parked more than 50 centimetres from the edge of the carriageway and not within a designated parking space I would like advise as to how best to tackle this issue as i intend to appeal in the next 48hrs. I dont believe this contravention occurred as never parked i stoped to let a passenger out on their request i didnt even notice the presence of the warden until after i drove off. Im a hackney carriage driver how am i suppose to do my job if i cant drop passengers off. Further more the time of the contravention was 00.59 it was a dead end street and i caused no obstruction to any traffic Is the worth appealing all help will be greatly appreciated Thanks in advance |

Any pics on council site? probably not. Sounds ridiculous - how long where you stopped? Boarding/alighting as an exemption.

Obviously Manchester CC are desperate for money !
However, whilst you are cross at getting this PCN, a few things do come to mind. The PCN has to be issued by hand to driver or vehicle, so you must have been stopped there for enough time for a CEO to see you parked and to produce and serve a PCN. So it seems it was not just a simple board/alight of a passenger. You really do need to tell us more about the circumstances so we can see if a credible appeal case can be put together. Be in no doubt, the council will bat away all representations as they keep the money if you pay-up. You must have a robust case to take to the adjudicators. The PCN penalty remains the same, there are no extra costs, but you lose the discount option. |

MCC have form for this sort of thing. A taxi immobilised after an accident, a taxi when stopped by a police officer and council official for license check.
Write a simple challenge you stopped to allow a fare paying passenger to alight, if you can show proof of a booking all the better Inc it was a postal PCN -------------------- All advice is given freely. It is given without guarantee and responsibility for its use rests with the user

Being served by post just shows their shear desperation for getting the cash rolling in, but much more narrative is needed to give meaningful advice.

Hi thanks for the replies i was only stopped for about 20-30secs maximum
I can only assume the warden noted my number and issued the pcn after i left No pictures of the alleged contravention as far as im aware |

Ive looked online theres 2 images one is taken whilst i was doing a u turn as the street was closed and another as i drove off

They behave badly like this because it is a money-making game and most times will get the PCN paid. As well as this, there are no penalties on them for so acting.

Most taxi drivers are just looking to make an honest hassle free living and manchester city council constantly target them because 9/10times the driver just pays up
Im going to put my appeal in tomorrow hopefully should i mention the massive discrepancy in the tome of the pics and the pcn. Do the warden video record the issuing of pcns? I would love to see a visual of this as i was there a matter of seconds infact he didnt even have time to take a pic of my vehicle stationary hes got pictures of a moving vehicle |

If everything that OP says is correct then this does look a lot like an abuse of power. Surely there must be some sort of disciplinary action the council could take against the CEO? It's not right trying to make revenue in unscrupulous ways. Shame on you Manchester Council. |

I will write out an appeal and post it on here by tonight or hopefully by tomorrow morning.
Does anybody know if its possible for me to request cctv from the council as it will confirm what im saying is true. The customer asked to be dropped off at this point and even in the pictures you can clearly see the bollards which means i couldn't go any further further. |
