Ealing council - 85 Parked without clearly displaying a valid permit where required

Any help would be appreciated.

My wife got a PCN notice for parking in Ealing Council Multi-story car park.

The PCN states this.

"Parked without a valid virtual permit or clearly displaying a valid physical permit where required"

The bay she parked in has no marking on the ground, and the car park has no mention of this as you enter the car park. As you park the side signs can be obscured by other vehicles. When she paid for the parking ticket using PayByMobile the APP does not mention make sure you are not in a "special bay". Also had a baby in the car so was preoccupied with that.

Any help would be appreciated, thanks.

Not at the appeal stage yet, just replying to the initial 14 day representation stage.

Post the council's pics and the PCN. Put pics on https://imgbb.com or such like.

Looks like those bays are for NHS staff (clinical commission group).

Excellent. I found my answer. The adjucator ruled the signage is misleading in a previous case on here. Im going for that one. Thanks folks.

Yes, it was emailed as an attachment.



The following line "Paying to park by phone or online is not usable here; it is only usable in the bays where signs says that it can be used".

Actually it doesn't state where you can pay and park but only where CCG and disable bays are, so you have to assume absence of a sign means its pay and display.
