Hi There everyone.

My brother got a fine on his car while parked up on a bank holiday near the beach.
I have tried to find out anyh information about this company buy not find anything about them.
Annoyingly it seems i can not appeal online.
Not sure what my best options are. Thanks in advance.

First post on here, but I am helping a RK in the same situation, but we appear to be 4 - 6 weeks behind the OP.

I got involved with RK late in the process after they made an appeal, so just looking to start geting all the ducks in a row in case a LBCC arrives.

They were alleged to have parked in the car park beside Quayside House (just to the south of the 's' in Aldrington Basin).

Not sure if this helps, but the pdf appears to show extent of Port Boundary and the type of area (see maps in the pdf).

Larger scale plan:

Port news letter about GXS:
https://www.shoreham-port.co.uk/News/port-r...parking-/168276

None of Basin Road (South) appears to be adopted highway. Brighton & Hove Council Highways Map shows that road between the eastern End of the Port and the Lagoon is adopted by them. West Sussex County Council show the road as un-adopted, but from a point midway along Basin Road heading west. I have not found who would be responsible for the bit in between - either Adur District Council or Adur & Worthing Councils.

Thank you for the reply.

I think my brother is just getting worried now that they are going to take him to court now and that time has run out to request all the info for gladstone to build a defence against them.
I think he is just going to pay tomorrow which i hate having to pay these cowboys but i don't know what else to advise him now.

Ok, brother was going to pay this but he got the letter from the dvla this morning. No one requested his details last year or no companies. So a NTK has still not been issued nearly 1 year on. Surely they can not fine him as keeper now?
Thanks in advance

If they do not know the driver then without a NTK they cannot hold the keeper liable. Even with a NTK but no contact with the DVLA then there is still no liability.

Failed POFA 6(1) (b) and 11(1) therefore no keeper liability

I thought so. Thank you ostell. How do I approach this with Gladstone now?

Write to Gladstones pointing the POFA failings and therefore there can be no transfer of liability to the keeper. Continuing with this matter when there can be no liability would be vexatious, unreasonable and amounting to harassment.

I'm in the same position with GXS/Gladstones in the Shoreham Port area. I think the etiquette here is to start a new thread. I have just received a CC claim form.

Don't hijack someone else's thread.

Ask them to confirm they are chasing you under pofa or otherwise.
