Hello Experts,

I have received this PCN for parking on a restricted street, was unaware that we can not park on that road, it was a Sunday and I parked on single yellow line thinking that we can park on single yellow on holidays and saw other cars were parked too. We visted Ruislip Lido and when we came back we found our car was not there and was towed away to the nearest car parking to make way for another car to be mistakenly parked and to go through the same process. Very few signs were posted and those too were very high and mostly hidden in the high bushes. Also there was no sign showing that cars would be towed away. Please could someone advise if we can avoid paying this. i am attaching both pages of PCN, if anyting else is needed, please let me know.

You really do need to get rapidly up-to-speed on parking on yellow lines !! Never park on any single yellow line unless you are aware of the restriction times. It is very puzzling that your car was towed to a car park and not to the car pound, where you would have had to pay a lot more to get your car back.

Did you not notice these signs at the entrance to Reservoir Road ? They mean "No Waiting" (aka parking) on any single-yellow line anywhere past the sign: -

The sign has no applicable days, meaning the restriction is for all days of the week between the times on the sign. The street also has double-yellow lines that apply 24x7.

Others will no doubt comment when you've updated your post, but at the moment, it doesn't look good.

Thanks for the reply, post updated with corrected title and pcn page 1. I did not notice the signs, the road was almost closed and there were people standing who were not letting anyone in, we requested and they allowed. On previous couple of occasions we had always parked in car parking and we had no plans to park on that road, it just happened that when we reached, one of the van moved and we saw a parking space and misunderstood yellow line rule.

If you submit representations against the PCN within the 14 day discount period and these are refused, the discount will be re-offered. I'm not too sure what you could put in your reps, (these will be informal), but the lack of repeater signs is a possible ground, because if you miss the signs entering Reservoir Road, there is nothing after the signs to remind you. However, this is not a very strong argument, but their reply could contain errors.

There is no legal requirement for signs about towing cars parked unlawfully. Frankly, you would seem to have been lucky as they could have towed you to the car pound and you'd have had to pay £260. The zone signs are present on GSV for 2021, so this is not a new restriction.

cp8759 may be able to get the traffic order, to see if they have implemented it correctly, but don't wait for this if the discount deadline is running out, submit your informal reps.

There are CPZ signs at the entrance to the road here and here, it would be worth going back to check the signs are still there and are not obscured, facing the pavement or whatever else (lost of these signs get knocked about by high-sided vehicles turning in and out of roads).

Another aspect is the legality of the signage, to implement a CPZ the order must actually create one, if the order simply creates waiting restrictions they cannot on a whim decide to use individual time plates for each line or CPZ boundary signs.

You have until midnight on 10 June to make representations and preserve the discount, I'd suggest something along the lines of what Incandescent suggests just to buy time. Hillingdon will almost certainly reject but the discount will be reinstated at the next stage as long as you challenge the Notice to Owner within 14 days, and I should get the traffic order back long before then.

Many thanks for your reply on this, I think there were signs when we were exiting that road and had the pcn issued, did not get to notice them when entering But other signs that were inside were almost hidden behind the bushes and were not visible. Would it be worth waiting for another 2-3 days if you would be able to get the order before then (just in case) and make representations on 9th June or so?

I’m not aware of whether anyone has received the traffic order.
Did you go back and check the signs?
We must see their letter of rejection. This looks urgent so please post a copy as soon as possible and also let us know about the signs

I could not to go there to check signs it is about 1 hour away.

Shall I post a copy here? As per previous advice, I thought we have to wait for Notice to owner (which I have not received yet) and then make a representation?

The Notice to Owner is sent by post to the name and address of the keeper as shown on the V5 registration document. So, are you the keeper, and is the address correct ?
