I was given a speeding ticket in france for going 140kph, in a 110kph zone. However I was within the limit of 133 kph as I had my cruise control at 80mph.
Also I was made to sign for my ticket electronically on the police officer's pda, despite me not reading french- is that legal? Could I appeal the fine as I am convinced I was within the allowance of 133kph. Has anyone else been successful in appealing a similar ticket? |

Did you pay at the roadside?

Why do you think you are allowed to go at 133 kph in a 110 kph limit, or that your car's speedo is more accurate than the police measurement?

So what exactly are you now wanting to appeal? (note the meaning of the word appeal....)

OK I'll take the plunge.
I don't know much about speeding enforcement in France, so where does this come from?: However I was within the limit of 133 kph as I had my cruise control at 80mph. Could I appeal the fine as I am convinced I was within the allowance of 133kph. Is it the French equivalent of "10% + 2mph"? If so it's quite generous because it is 10% + 12kmh (about 7mph). Is it the French equivalent of "10% + 2mph"? If so it's quite generous because it is 10% + 12kmh (about 7mph). Having recently returned from driving in France myself, I've also wondered about that. The UK guidance may be relatively generous, compared with the Swiss and Italian speeding tickets I've seen (not mine...), so I wouldn't be surprised in the French enforcement threshold was lower than in the UK. I generally stuck to the limit +/- 5% per GPS, but in theory they could be enforcing "zero tolerance". The French have an increasing number of permanent cameras, but I had always heard and believed that if stopped by the police at the roadside that the fine was payable on the spot--to include marching the driver to the nearest cash machine if necessary. If they did not do that, how does the OP know he is actually being prosecuted? Perhaps it was just a written warning. There are ECHR requirements relating to the right to have criminal charges and the hearing conducted in a language understood by the defendant, but I have no idea if that extends to whatever document the OP was required to sign--it may; it may not--which depends on what that document said and its purpose. --Churchmouse |

TO OP...Are you in The AA or RAC. At one time you could get " legal" advice from them .

So you live in France and have a French address? French plod normally demand cash on the spot from foreign drivers, as they can otherwise simply leave the country. -------------------- If you would like assistance with a penalty charge notice, please post a thread on https://www.ftla.uk/index.php

French speed enforcement starts at +5kph if limit is <100kph and +6kphif limit is >100kph.
The tolerance is the "marge d'erreur" and the prosecuted speed is the "vitesse retenue". Camera cars have a higher tolerance and can record in both directions and multi-lane. French speed cameras. Your post makes no sense. What was the speed shown as vitesse retenue? If it was 140kph then you were actually recorded at 146kph which, in a 110 kph zone, would be expensive. The amount of penalty (amende) would indicate how much over the posted limit you were. My link above shows what a French speeding looks like. If you didn't pay on the spot it suggests that you produced a French driving licence. This post has been edited by baroudeur: Mon, 17 Sep 2018 - 14:05 |

Thanks Baroudeur, that's interesting - I've often wondered about the speed tolerances across the channel.
