West Yorkshire Police investigated the incident but took no further action against Mr Tomlinson following advice from the Crown Prosecution Service.

I fully accept that these devices can be used to provide corroborative evidence ( as per common law ), but, in my opinion, they cannot be used to provide specific evidence of an actual speed. The officer can state that he/she formed a prior opinion of speeding and used said machine to corroborate his opinion. The evidence from the machine can be used to "confirm" the officers opinion that the speed limit was being surpassed, but not used to produce an "actual" speed that the defendant was travelling at.

PPP should obtain and keep a copy of the offending video. It can be brought out at parties...

Im working on a BBC1 consumer motoring series presented by Dominic Littlewood from 'The One Show' and I am looking into problems with parking tickets either unfair or dubiously issued tickets. We are holding a 'parking fines clinic' in Birmingham next week on Friday 21st where the public can come along and meet a panel of experts and find out if they can get their tickets overturned. The panel will consist of Ollie Mischon, transport lawyer who writes as 'Judge Tread' in the Sunday Mirror and Neil Herron who is seeking a judicial review into parking enforcement.

I am on the look out for stories in the Birmingham area that we could invite along to the clinic and I wondered if there were any interesting cases that have come in to your site which you may be prepared to help us make contact with and invite along on the day?

Brighty -v- Pearson [1938] 4 All ER 127

In this case the defendant was convicted on the evidence of two police officer, the second corroborating the opinion of the first as to excess speed.

The Constables, and the Bow-street men from London – for, this happened in the days of the extinct red-wainscoted police – were about the house for a week or two, and did pretty much what I have heard and read of like authorities doing in other such cases. They took up several obviously wrong people, and they ran their heads very hard against wrong ideas, and persisted in trying to fit the circumstances to the ideas, instead of trying to extract ideas for the circumstances. Also, they stood about the door of the Jolly Bargemen, with knowing and reserved looks that filled the whole neighbourhood with admiration; and they had a mysterious manner of taking their drink, that was almost as good as taking the culprit. But not quite, for they never did it.

It definitely wasn't either of those.
