It probably has more to do with the law than justice. As they were initially unaware of the details of what happened at the time of the incident, West Yorkshire Police were probably unable to serve a NIP on the driver within 14 days. I fully accept that these devices can be used to provide corroborative evidence ( as per common law ), but, in my opinion, they cannot be used to provide specific evidence of an actual speed. The officer can state that he/she formed a prior opinion of speeding and used said machine to corroborate his opinion. The evidence from the machine can be used to "confirm" the officers opinion that the speed limit was being surpassed, but not used to produce an "actual" speed that the defendant was travelling at. There are already examples of cases where this has happened. For example, in the following case, the rider was being prosecuted for riding at over 100mph but the magistrates decided he was riding at 85mph. |

A 30-year-old police sergeant traffic offer jailed for five months for crashing his car at more than 110mph has been cleared of dangerous driving. Craig Bannister, of Briton Ferry, was bailed by the appeal court earlier this month after serving just 20 days. |

Depends on the situation, the ruling in Young V Day made it clear there is no set accuracy, that between say 2jcts on an mway 3 miles apart may be OK, while 'Oxford street, London' would not, as there are landmarks available to create a better locus This case keeps getting refered to here.
