This came to me as an off-forum case, starting to feel very run-of-the-mill now:
The preliminary point taken by Mr cp8759 on behalf of the Appellant, is that the camera stated to have been used to record the contravention is not the type of camera approved by the Secretary of State. Does it not give rise to a reasonable request for costs ?
Given an authority has been told it has no admissable evidence surely any refusal of representation correctly mentioning that is nothing short of vexatious. Even issuing the things on the hope somebody will just pays is a bit unreasonable. |

I think I might go for costs with the next Whipps Cross case, this was the first Barnet one I've won on this ground.
