Hi all
I've just joined today in a bit of a panic!
I've just opened a bundle of letters from QDR. I have received 4 formal letter of claim letters from them.
One letter of claim is for a list of 4 PCN's dated 29/06/16, 25/11/2016, 11/07/2016 and 30/6/2016. It says unauthorised long stay. These are all 2016 - there are no details where these were and I have no idea what to say about them.
The other letters are for dates in 2018 and 2019. Two of these I appealed as I paid but accidently put the wrong location code in.
In total they are claiming over £1,500 !!

Does anyone have any advise how to deal with this? Should I ignore the letters? Or should I reply that I do not owe the debt or complete the box I need more information about hte debt.

I absolutely can not pay this.

The SAR is against a person's details, everything against your name, it's not against an event, so you only need one SAR.

At the same time you can remind them that, if the claims are substantially the same, it's a breach of CivPR to make two separate claims.

Good lord, I've just received another Claim - this one is £914 from June & July 2016. . Date of Issue 4 Feb.

This the one I listed out in my first message on this forum thread.
I actually realised when I did a bit of checking and digging that this is the one I had emails and phone calls with a NCP customer service advisor on sorting out in AUgust 2016. I had a text payment from dash to say a payment had gone through for a payment for about 11 days. But it actually didn't go through and when I got back from holiday there were about 8 NCP letters for each day I had not paid. I had lengthy conversation with one particulr NCP admin girl who was super helpful. I sent her all the infor she asked for and I followed up with 2 more emails asking if she had everything she needed and asking if she needed anything from me. That was it. I never heard anything more until Jan when QDR sent me the bundle.

Now they are making a claim.

I have emailed NCP asking what has happnened as I understood this was closed in August 2016.

So in total QDR are putting through 3 claims totally £1,700 !!! Which is I guess why there are doing it. I know people have said NCP can only put in one claim but they are not so where do I dispute the fact they have put in 3 against me? In my defence pack as well as the SAR?

I am going to counter claim on them for harrassment but I have to do that against each claim for the max amount, there is £65 fee. Do you think that is why QDR have put in 3 separate claims so you have to pay 3 times if you come back fighting them and try to claim against them?

Hi all

I've now had 4 court claims issued - all from NCP for Harold Wood and brentwood train car parks -' when you say it's a breach of CivPR to make two separate claims.'

Will the fact that can't make separate claims be part of my defence? and will 3 of the claims not win then ?

They can separate the claims for different sets of facts (like different car parks), you can as for the 'similar' cases to be heard together or once the first is heard ask to have them all be treated the same (if you win, you ask for the others to be dropped as they revolve on the same facts).

If these are station car parks then byelaws almost certainly apply and only the driver can be liable.

Have you acknowledged the claims?

Issuing separate claims is not a defence - but possibly adds extra weight to an abuse of process and is claiming unnecessary fixed costs.

Continuing thread here. I am defending the four claims taking place against me. I defended one for £914 using Coupon Mads defence template. The easy one was defence based of the fact it was sorted out with NCP back in 2016 and I paid £100 fine and they waived the other. I have the emails with NCP so I am very much hoping that goes away now.

However, for the other Claims I don't know what to put in for my defence (2 & 3 of the template) and that is where I'm hoping someone can help.(I have looked around the forum for something similar but struggling.
One of my claims dated 4th Feb, I put my AOS in on 9th Feb. So I have to do this tomorrow. The claim is for total £449! According to the particulars of the claim these are parking charges of £100 each plus contractual charges of £164 incurred in the collection of the debt.

For both these tickets I received - my Dash payment ran out at 04.00 the day before. I drove into NCP Brentwood car park, parked in the late morning and ran for the train, I started my Dash payment on the train but got stupidly side tracked and didn't complete it till 18:00 ish on my dash payment. I have the dash payment text to confirm I paid but obviously I was ticketed before then. There was lot of workman around and temp traffic lights in and out of the site. Can anyone help with what I can base my defence on? Signs not explaining clearing you only have a certain time to make payment? Works going that were distraction? Or the signage not being clear in all areas of the car park?? I just don't know!! ANy help appreciated.

The Rookie - That is what someone said on MSE also - so I can say I was not the driver on my defence and they can not pursue it, is that what you mean?

Jlc - So I look to add more weight to the abuse of process bits of the defence?

[NCP are cancelling the claims against me. I have been dealing with their customer service manager who in turn had raised a new case about the 2016 issue. 3 of the tickets on that claim had been cancelled 2 years ago they said. They don't know how QDR had got hold of these. So they are cancelling that claim.

Then he called again this evening to say he is removing all of the PCNs against me. I will receive an email over the weekend. I guess I just note that in my defence section of each claim when I receive the email.

I have half a mind to counter claim against QDR but I don't know if that is possible

Also, they should only be acting on instructions from the principal. Might be worth trying a complaint to the SRA too.
