92 in 70, clean driver

Hey Forum,

Been a while since i was here - but have a question. Before posting yes they should have not been doing this sort of speed it is completely wrong.

My brother has gotten a speed ticket clocking 92 in a 70 - which is a Band B offense (4-6 points or disqualification up to 28 days) however the fine is based on income, he is a student and does not have a job, does anyone else know how this is then calculated? I tried looking online but i cant seem to find anything!

He has a clean license and has been driving for 3-4 years with no previous offenses.

At that speed, your brother should be offered a fixed penalty - £100 and three points. (Assuming it was in England or Wales). Unless he has a defence, he should accept that.

The Band B only applies if the case goes to court.

Hi there!

Thanks for replying, that was really insightful! Is this because he is only 1-2mph into Band B joint with his clean license so they would make an exception? (Or maybe my understanding of the system is flawed haha apologies)

The banding is from the Magistrates court sentencing guidance, if a fixed penalty is offered and accepted then the guidance is irrelevant.

The Police guidance on when they will offer is set by the National Police Chiefs Council (and is discretionary) and completely independent of the guidance.

Don’t worry you’re not the first person to get confused by the shockingly badly reported changes which wholly confused everyone not actually familiar with the process.

The NPCC guidance is to offer a fixed penalty for up to limit+25mph in all limits of 40mph and above (less tolerance in a 20 or 30)
92 being less than 70+25 a fixed penalty is all but certain to be offered.
