Was stopped on a 70 motorway by a patrol car.
"I've stopped you for excessive speed." "Why were you traveling so fast?" (Didn't realise) "Is it your car?" (Yes) "Where are you traveling?" (On my way to work) "Can I see your licence?" Checks licence for 2 minutes and presumably the number plate or video in the car then comes back "You've been doing at least 90, it's on video.Don't do it again. We will hear your aftermarket exhaust a mile away. Drive safely." They didn't mention what will happen. Is it likely that I will receive a fine in the post in the next 2 weeks or will I be put onto their system as having had a warning? This post has been edited by cel123: Tue, 16 Jan 2018 - 17:00 |

There was no caution or indication whether I would get a fine in the post or not. Just that they got me on video and not to do it again. I wasn't sure if they would need to inform me if I was being prosecuted or fined since since they could bluff that they did provide a verbal statement at the time if it was required later on. Also a mobile speed van would just send the FPN through the post, so I'm assuming a patrol car wouldn't need to inform me?
I have read some of the pages on this site but it seems there's no way to know for sure until 14 days is up. |

A caution wouldn't be required in a normal speeding stop.
If they told told you at the time of the stop that you were being reported for a prosecution to be considered (or words to that effect) then that would be a verbal NIP and the 14 days you mention is irrelevant. The next communication could be weeks or even months away. But from what you say it sounds like a simple warning, and you will hear nothing more. |

I have read some of the pages on this site but it seems there's no way to know for sure until 14 days is up. If you were given a "verbal NIP" there's no way to know for sure until a little over six months is up. There is no requirement to issue you with a written NIP (to which the 14 day rule applies). If the offer of a Fixed Penalty is to be made (for which 90mph in a 70mph limit usually qualifies) you should receive that quite quickly. But if court action is taken they have six months from the date of the alleged offence to begin proceedings. |

They bring light to my dull day If no caution was administered and the evidence from the interview was thrown out would the prosecution still have enough to convict? Almost certainly, so in that respect it doesn’t matter. With regulars I often try to encourage them to research the answer for themselves.
