Hi folks...
I was caught today by a police officer with a radar gun who was stationed about 100-150 metres inside a 40mph zone after a 60 zone. I'm not necessarily saying that speed recorded is wrong, but I know nothing about how the devices work. I do know that given where she was standing (on the corner of a side road, in full view) I don't think I would have been able to smoothly slow down and stop right next to her after seeing her step out to flag me down had I been doing that speed inside the 40 zone. I think it's possible that she tagged me whilst I was still in the 60 zone. I know the road, and I know where the limit changes, I was slowing down anyway, so I can't see how I could have been doing 59 where she said I was doing that speed. I simply would not have been able to stop safely in that short distance If I was. So, can I argue that I might have been outside the zone when she tagged me, and if so, how? Also, the officer showed me the reading on the back of her device. It did indeed say 59. How do I know that that reading was taken on my car? After all, there's no picture... I can upload some photos of the location tomorrow if it helps... This post has been edited by Son of Kernow: Mon, 15 Oct 2018 - 19:47 |

For starters it would have been laser, not radar.
They will know the distance to where your speed was measured - what's quite common is that they'll measure the distance from their location to the speed sign. (This way they can show you were within the 40mph limit) Pictures aren't needed to convict. For that excess you'll get a 3 points £100 fixed penalty offer. Think carefully before rejecting that offer as the matter would have to be challenged at court. I can upload some photos of the location tomorrow if it helps... A Google Street View will probably work just as well. -------------------- RK=Registered Keeper, OP=Original Poster (You!), CoFP=Conditional Offer of Fixed Penalty, NtK=Notice to Keeper, NtD=Notice to Driver
PoFA=Protection of Freedoms Act, SAC=Safety Awareness Course, NIP=Notice of Intended Prosecution, ADR=Alternative Dispute Resolution PPC=Private Parking Company, LBCCC=Letter Before County Court Claim, PII=Personally Identifiable Information, SAR=Subject Access Request Private Parking - remember, they just want your money and will say almost anything to get it. |

The fundamental question is whether or not you were exceeding the speed limit, not your exact speed. If you accept you were over the limit, it does not matter what your speed was, as long as it was below 65mph you will still get a fixed penalty of £100 + 3 points.
