Hi, my girlfriend received a parking ticket on Saturday while her card was parked on the pavement.
The road outside my house has double yellow lines, so we have always parked on the road for over a year. Many cars on the same road also do the same, however the double yellow lines dont go all the way up the road. There was plenty of room for people to get past the car with a pram etc so i am not sure what the issue was. Is this normal practice? Is it worth me disputing? Thanks in advance for any help. I have attached pictures of the 3 vehicles, hers is the mini. |

Understatement from DD - bang to rights bar a slim hope of legitimate expectation.
The road looks quite wide - what on earth is wrong with parking on the carriageway away from the yellow lines? |

Let's see the PCN and location please. It's not looking good from those photos. Its in the north west (code 01.) Parked in a restricted street during prescribed hours. Understatement from DD - bang to rights bar a slim hope of legitimate expectation. The road looks quite wide - what on earth is wrong with parking on the carriageway away from the yellow lines? The pavement is always full of cars, to park somewhere else that isnt normally full would be a 2-3 minute walk. Always parked there since we moved in over a year ago and never had any complaint. |

I don't get that bit ...did you mean "on the pavement" As for the DY's ...the restriction aiui stretches from the centre of the carriageway(road) to the property line ( across the pavement to the wall) Surprising that you haven't had any tickets previously . Can you post up scans/pics of the ticket ( excluding the usual stuff) and others will give their opinions. Use an external host not the Forum attachment facility . |

Redact/obscure name, address, PCN number and reg.mark. LEAVE IN all dates/times; precise location, Contravention code and description. |

The DYLs bar parking 24x7 and this includes footways and verges up to the property line, which on your 2nd pic of the mini is the low wall. No separate signs are needed. So on the face of it, your girlfriend is bang-to-rights, but if you've regularly parked at that spot with the DYLs then an appeal based on "legitimate expectation" could win at adjudication, but the council will not give way so you'd have to take it all the way and forego the discount option. Only other possible avenue is the PCN itself. Sometimes these contain fatal errors of content that make them void, but again, you'd have to go to adjudication to test the matter. You're bang to rights on the contravention, for the reasons stated above.
Unless there are fatal flaws in the wording on the back of the PCN - please post it up - your options are limited to:- 1. Contest on "Legitimate Expectation" as stated above, with the full £70 at risk. This will only work once. 2. Pay at the discount and don't park there again. |
