POPLA Appeal Successful

Summary of your case
The appellant’s case is that they are appealing as the hirer of the vehicle, and that the operator has not complied with Schedule 4 of the
Protection of Freedoms Act (PoFA) 2012.
The appellant has advised that the operator can pursue the driver of the vehicle but they are not under a legal obligation to identify them.

As the operator has not demonstrated that it has complied with section 13 and section 14 of PoFA 2012,
I cannot conclude that the Parking Charge Notice was issued correctly.
