The other references a car which has nothing to do with me or my company, but is also addressed to the company.

Has the VRN EVER been connected to your or your company?

I was led to believe I could identify the driver at court proceedings.

Incorrect. Your time to identify the driver would have been up shortly after you received the reminder.

Should I not have received a court summons.

You mention receiving a SJPN (the modern replacement for a summons)?

The next letter that arrived was the Offence summary or possibly SJPN ? .

If you know you received a SJPN, then how can you file a SD?

You can not, under oath, declare you were unaware of the proceedings against you..

I received a PCN for stopping on a Bus stop. The PCN is dated 11/12/2017

Linked to your previous thread also for bus stop PCN in December 2017?

Any delay with this issue would be welcome as I already have 9 points

Qualification for SAC depends on offence dates, otherwise everyone would try to delay proceedings to suit themselves.

Same applies to totting ban.

Still committing the offence, covered or not, able to work or not. Whether it’s in the public interest to prosecute is a different matter.

Funnily enough, as far as I know, there isn't a law that says I can't drive along while my passenger is holding a battery powered blue lamp (which could even just be an app on their smart phone).

Who mentioned passengers and handheld lamps?

Thanks all. I don't know for sure that the land is private but have probably parked here 20 times previously. Are you saying that ownership is irrelevant due it being a verge with public access?

Thanks

Basically, yes (and you're parked adjacent to DYLs) There's a well known High Court case which cost a moped-owning Dr Dawood a lot of money. Give it a read.

but could appeal on "legitimate expectation" if you've parked there many times before without getting a PCN.

OP, to save problems in the future, bear in mind you're now on notice, so can't claim legitimate expectation again. Best to find somewhere legal to park.

Sorry, what is the relevant traffic order ?

The Traffic Regulation Order is what sets the limit on the road. You can find a copy of it at the local council offices. If the TRO is not correct, the displayed limit may not be enforceable.

The police have 6 months to commence proceedings. They would seem to be well within that time. What makes you think the SJPN is out of time?

It sounds like a roadside stop so you have no doubt re. the details e.g. location etc.

None of your points will prevent a successful prosecution.

If a ban is being considered, it is likely the case will be adjourned and you'll be given a date to attend court.

The reason I have three PCN's is because I didnt know about the camera until I received the first PCN. I then obviously changed my route.

I wouldn't put that as a reason for appeal!

I was on double yellow lines next to the place that issued the receipt for fitting a new car battery.
Any help greatly appreciated.

So just to be clear, your battery luckily failed outside a car battery shop?

Is receipt dated same date as PCN?

How long before car was driven away with new battery fitted?

Post up all sides of PCN. And CEO photos should be online - GDPR request unnecessary.

Merely having them fitted is an offence IIRC.

The Road Vehicles Lighting Regulations 1989

16. No vehicle, other than an emergency vehicle, shall be fitted with–

(a)a blue warning beacon or special warning lamp, or

(b)a device which resembles a blue warning beacon or a special warning lamp, whether the same is in working order or not.

Are you the RK? If yes, and V5 is up to date, you should be in the clear.

The DYLs look "substantially compliant", i.e. in good enough condition to convey the restriction to a reasonanle person. They do not have to be in perfect condition and require no time plate as they are a 24/7 restriction.

DYLs cover from centre of road to boundary with private property.

Looks bang to rights. Let's see a GSV.

You could possible claim legitimate expectation, but you're now on notice and need to find somewhere else to park.

Who is the RK of the car?

I have received a second NIP asking for the same info again.

To be pedantic, and to avoid confusion, you haven't received a 2nd NIP at all. This is the first NIP YOU have received.

And as stated above, it is perfectly normal for you to receive a NIP in your name after nomination by A N Other.
