Parking Suspension (dates not in chronological order)

Hi,
My partner received a PCN from Kensington and Chelsea council for parking in a suspended bay. It resulted in his car being towed to a neighbouring street. He stated he parked there because he could see there were multiple dates but only read the 1st date as they are usually in date order starting with the earliest date. Im sure they make these signs as confusing as possible to catch people out.

Ive searched and searched online for any rules/guidance of how council should display their suspended bay signs but I am unable to find anything in regards to multiple dates and the order.

Ive attached a picture.

Date of PCN?
As usual, for best advice also post up here all sides of the PCN and GSV(Google Street View ) link to the location.

Try this:

Do not attach docs/photos, but use this method:

Photo or scan. see http://forums.pepipoo.com/index.php?showtopic=36858&st=0
for how to do it. I use Tinypic for stage 2 with no problems. Thera are other sites, such as Flickr (where the BBcodes are concealed behind the curly arrow (click on it) for sharing), and Imgur which enable you to paste the BBCodes into your post here.
STAGE 1 takes care of resizing. If you use Tinypic for Stage 2, on the left each image in Tinypic is a list of links. Highlight and copy the entire link 'for forums' from the list for each image - beginning with IMG and ending /IMG (include all the square brackets [ ] ), and paste each link into your post. Each copied and pasted link will embed a thumbnail link in your post.

Using the attachment method is not advised as it means quickly running out of attachment space.

Redact/obscure name, address, PCN number and reg.mark.
LEAVE IN all dates/times; precise location, Contravention code and description.

Don’t get hung up on this quest, it’s a dead end.

The law ( their TRO, the RTRA and LATOR - don’t concern yourself with acronyms, we can deal with these later) combine to give simple requirements:
Signs must be lawful (both in terms of them being underpinned by a lawful restriction and being specified or authorised) all of which are designed to achieve the outcomes of legality and clarity.
Signs must be in the right place.

Ultimately an adjudicator would decide whether the sign was clear given the balance to be struck between legal requirements as regards the signs, the authority’s obligations to give warning of suspensions (especially in res bays) and practicalities.

It’s easy to construct a fitting scenario here:
Yellow sign erected 29 June giving 10 days’ notice for location A;
Second suspension for location B which overlapped with location A to come into effect 6 days after the first ends;
But the authority give at least 7 days’ notice and as this was for a different location it required a separate notice;
But there was already a suspension sign on this post (presumably) within the total extent of A and B.
So what to do? Put a completely different suspension sign with a single notice on the same post or, as they did, just put another notice on the sign?
They couldn’t plaster the second notice over the first because on the day of erection (10 July) the other suspension still had a day to run.
So they put it above.

And this is where your friend’s account seems odd. Presumably they hold a res permit, otherwise they shouldn’t have parked there anyway at that time. So in all likelihood they would have seen the sign when it was first erected in late June when the lower notice was on its own. They might even have been notified of the suspension by the council. How could they be confused if they park there regularly?

Pl fill in the gaps in our knowledge.

I don’t think an adj would buy the ‘I was confused by the signs’ line on what we currently know.

Gsv is google street view, just find the location and post the link.

The Council pics you can get from the Council website, it's only by seeing these pics that we can advise whether it's worth challenging the pcn.
