Hi there,

I hate to ask for advice on this matter but my father who is incredibly stubborn and inflexible, drove himself to hospital with health concerns in July 2019, parked in a free bay (20 minutes duration) and ended up actually being kept in overnight.

He received a windscreen sticky with a PCN inside, and asked the car parking staff to cancel the ticket explaining why his car was there for so long. They declined to cancel it.

He then lost the original ticket and has just had the NtK in the post this morning asking for the full amount.

Is there any way this might be cancellable or able to be challenged? One thing I can add is that the name on the NtK is slightly inaccurate, using my fathers middle name, which doesn't match up with his licence which has his full and correct name on it.

Despite my better judgement of having my stubborn dad pay up and learn his lesson, he is a pensioner and doesn't have cash to throw away left right and center, so any advice would be appreciated.

They use the details on the V5C - it's more than likely wrong on there...

Hi JLC,

Yes on part of the letter states "This notice is given to you under Paragraph 8 (2)(f) of schedule 4 of the Protection of Freedoms act 2012 and is subject to our complying with the applicable conditions under schedule 4 of that act".

Is that the piece you mean?

If the hospital are declining to cancel, that’s the one time your local MP may prove useful.

If you use the template appeal shown in blue font from the MSE NEWBIES FAQ sticky, post #1, CP Plus often back down on receipt. As, from memory, CPP NtKs are Protection of Freedoms Act 2012 (Schedule 4) compliant, hiding the identity of the driver is of little value, your father could add that he was admitted to hospital as an emergency case and was not allowed to leave to move the car. If he has any hospital documentation to prove his hospital admission, copy those with the appeal.

CPP very often cancel when they see a forum-based initial appeal. CPP are not litigious.

CPP is a training name of Parking Eye now, the issue they have with PoFA compliance is no duration of parking, last time I saw one it had an entry and exit time from which a time in car park can be derived but it’s not duration of parking.

The thread title says CP Plus, so it's on that basis I've commented. My 'CPP' acronym was not with Care Parking Partnership in mind.

Too many parking companies having similar names/acronyms.

@ OP - if it is Care Parking Partnership (not CP Plus), then you might have to deal with it as per The Rookie's advice.
